  • I think it’s hard to say that I subsequently visited and saw the signs……. My reasoning is that the signs appeared to indicate no parking in the industrial sites due to the signs being located on the gates, which was very misleading. However, at a subsequent visit additional signs had been erected along the roadway, I wonder why!

    Ok but I'd suggest you still need to re-write it, more along the lines I suggested (just drop the bit about any subsequent visit).

    Your draft was, IMHO, the opposite of the message you want to get across and merely tells the Judge:

    'I saw this sign and I also saw that sign, and oh yes, there was a big entrance sign too'

     ...which loses the teader immediately and supports the claimant's case.

  • Coupon, thanks. I will do that. I have just received a reply from my data protection request. A photo shows there is a sign on a fence directly next to my car. I obviously don’t remember seeing this. It was not there on my subsequent visit, which I have a photo of.

  • I was thinking the same thing! Thank you I have now hopefully got this about right. 

    2.       It is admitted that the Defendant was the registered keeper and driver of the vehicle in question but liability is denied. 

    3.    Whilst the Defendant has now seen from a subsequent visit that there are a few sparce, small printed signs set back on odd gates/walls of some unit entrances. The place where the car was parked is unmarked, looks like a public highway not private land and has no lines or signs to alert even the most observant driver to any terms or penalties/charges.

    All part of the process and very normal, keep checking your MCOL login and view the status to see when CCBC send you a N180 (DQ).  Make sure you complete it and send it back with copy to the claimant.  Do not be fooled by the claimant sending you a copy of theirs.
