    So you intend to have two employers simultaneously, yes I can see this ending in years given the workplace is toxic, especially if it's a similar role you're moving to.
    Do you intend starting the new tile while signed off?

    You’re working for a supplier at the same time you’re officially employed by someone else, and you’re planning on pretending to be sick while hoping that employer one doesn’t find out you’re working for employer 2 while you’re still on notice from them.
    Even if employer 2 doesn’t want references and doesn’t care that your tax code shows you are still employed elsewhere, it’s not showing you as the most honest or reliable of employees, is it?

    So I am on annual leave and as far my current employer is concerned I finished and on annual leave. I haven't been put on gardening leave or the contract (no written clause) doesnt forbid me working elsewhere. 

    Yes the work place is bad and i am leaving!

    Are you saying the immediate managers would try to destroy me my career?

    Ah Elsien I see what you are saying- no I haven't explained properly. "If I" were to go sick that would be in the next two weeks. I am starting  a new employment until after that.

    Sorry the last sentence is "I am not starting...." so no I wont be employed by two people simultaneously except when I am on annual leave for my first employer

    Thanks oh really. Why is that a problem? The contract doesnt forbid me neither I am on gardening leave.

    It would be prudent to safeguard yourself be getting your current employers consent before commencing your new role.

    Unfortunately I definitely wouldn't be doing that. Worst case scenario they will call me into disciplinary for gross misconduct? And either not pay for my annual leave and stick to basic entitlement. Even in that case I will simply turn up to hearing and just show my contract which has no reference to taking up second employment neither any explicit reference anywhere on HR guidance saying that though.
