SNAD or my fault

    Although an SNAD might fail, this must be a situation where feedback should reflect the experience and I would not leave a positive if I were the OP.  One has to be careful of wording feedback but how about something like
    These tiles are much smaller that they look in the photo.  Although the correct 6cm size is in the listing, the seller acknowledges that their photo is misleading.

    Whilst I think your wording is brilliant, I may ask you to word something next time I need to make any comment in feedback I would be cautious about leaving a neg, perhaps a neutral. How many threads have we had on here about buyers who can’t read a listing? On those threads it often influences whether a seller will take an offer from someone, or block them. I would certainly think twice about taking an offer from anyone who had left a negative for something that was clear in the listing.

  • Photos can be misleading even through no fault of the seller, the item description is part of the sellers offer, so you need to read it in order to know what you're buying. As soolin says, any reputable seller would be able to appeal an SNAD case on the grounds that the description clearly states what is for sale.
    Having said that, if you contact the seller and explain that you found the photo misleading they may be prepared to offer you a free return or refund without a return. All you can do is ask, and make sure that your feedback reflects your experience. Be aware that if you leave a negative that claims they were misleading they may be able to get it removed unless you specifically state that it's just the photos that were misleading.

    Thank you for all your thoughtful responses. I am undecided on what to do next. I do sell a few bits myself from time to time. I wouldn't put up a misleading photo and then say it's misleading. It seems daft. Surely an honest picture would be better?

    well i am with you on this - it is like putting a photo of a real full size sofa for sale, but mentioning in the description that the item is for a dolls house.
  • I vote for SNAD, seller in China will probably try a part refund and then give in if you decline.

    Personally I think the photo is misleading, the MBG T&Cs doesn't go in to details of what it means for the item to be as described but says eBay will check to see whether the seller breached eBay policies when listing the item and the photo policy says The following are not allowed: Photos that don't accurately represent the item

    I think the average person would look at that photo and expect tiles bigger than 6cm in height.

    I have printed my returns label and the seller has offered me £1 back if I don't return the item which I have declined

    That’s a SNAD so once you won the case, or seller accepted the return then your return label was paid for by the seller , so that’s probably why the seller was trying to get you to keep it for a small discount. Obviously you can continue with the return and let seller worry about it.
