There have been some good well-written WSs recently that supersede that in the sticky.  Look for any posts made recently by @Coupon-mad and/or look at these: -

Thanks Le_Kirk. I used the witness statement that @aphex007 helped with.

I am not sure about  wording in WS points 16 and 17 as the parking firm claims no grace period applies.

    ***new WS below****

The link is editable.. cant work out how to make it read only but I have a local copy saved.

Thanks for all the help in advance.

The IPC CoP has never allowed 10 mins either side of a parking period.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Thanks Coupon-mad. I will take it out altogether however I think it was in my defence (posted earlier?)

the cop states that no grace period applies if parking is less than an hour. But also starts with being given sufficient time to read etc the signs.

Any guidance of what to say instead is appreciated.

Can you also take out all references to BPA   -  for instance Content schedule and para 18.

That is an unfortunate side affect of using a template but it is only provided for examples of format and style and the content must refer to your own circumstances and back up and support your defence.

    hi guys
I just received their WS this morning. They have added on a load of extra costs at the end £658!
plus they accept grace period but then go on to say it doesnt apply (contradict themselves?)

Their entrance signs also do not have any detailed terms or conditions on them and it is really small.

Here is my new WS amended for comments received above:

*** new link in post below ***

And their WS redacted (i hope i have redacted all identifiable information!)

Should I be adding anything on re the amount of legal fees claimed in a small claims court?

Also they say i didnt challenge the PCN, but i did and I have proof of that by them rejecting it! (is that something to mention??)

It's due on Monday 18th - is electronic service to court and claimant appropriate or should i also send a physical pack?

    thanks!

The added costs is a normal scare tactic ... unless you act unreasonably (e.g. don't file a WS, don't turn up for the hearing without prior notice) then there's not a chance in hell of these being allowed.

The latest accounts for Wembley Park Ltd-31st December 2020-indicate that they sold all of their properties in the year; so they are probably not the landowner.

Thanks for this information. How can I prove it? I could get the company house accounts added to the evidence pack?
