    Not having seen you here since October makes me worry you might not know about the new Code or the fact the Govt has banned the pseudo debt recovery costs (new on 7th Feb 2022) and haven't read other threads from recent days that cover that?  I am concerned you may have used an old WS example.

  • Oh my god. Thank You so much.  Yes that is the first I have heard of this.
    Not very good with this type of thing and worried about sending it too late or
    to the wrong place.

    I have not yet posted the Witness statement but intended to do that today. 
    I really need to get these to them fairly quickly, court date 24th March so very short notice
    to be asking for help. I have been up all night editing the witness statement and have
    now added the new defence sections from your link. Certainly pads out my statement.

    N157 form does not mention an email submission.  By post, DX, or personally delivered
    to the Birmingham County Court.

    Birmingham Civil Justice Centre. Bull Street B4 6DS.  Sadly they changed it from my chosen Walsall which will be 
    awkward to get to with a disabled person and no low emission vehicles to enter the City.

    Still unsure about whether the other copy is sent to BW Legal or Total Parking?

    Please help, thank you.

  • PS. This is my Witness Statement not the defence.  

    I am getting flustered now knowing this needs to get there soon.

    It can be emailed to the court plus BW Legal.  You could also post a copy on Monday so you know they got it, making sure the covering note refers to the claim number, and date and time of hearing, so it isn't misfiled.

    You will of course be pointing out that their witness statement that accuses your Defence of being a template is itself a template that has been seen hundreds of times. 

    Just search the forum for the word nonsensical.

    Ironically, the new template defence (written a week after you submitted yours) rebuts the accusation that it's a template defence.  Have a look at the template defence thread again and you can see what to say at any hearing, if criticised. 

    But you don't reply to that BW letter anyway.

    They want to speak to you! 😄. 

    No doubt they want to make you an offer you can't will refuse!  A pattern we see which can often lead to a discontinuation. Keep playing the game, but block their telephone number. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
