install log burner

I want to install a log burner into an existing fireplace, normally this would be straight forward, however, i live in a conservation area, so require consent from the local planning dept, the problem i have is that the existing chimney access point on the roof is on the "front elevation " and faces the highway. ( the old chimney stack was removed a few years ago due to safety and tiled over). Im unable to do a pre application inquiry as this service is not yet up and running. Does anyone have any idea if this would be approved, before i go ahead with architectural drawings etc, the local planning office are not able to give advice.
