Appliance City Charging a restocking Fee against distance selling Rules

Ordered a kitchen appliance from this Appliance City (AC)  using their website. They tried to deliver the item at 7am but they did not contact me an hour before as agreed and set out on their website so I missed the delivery. They then said they would redeliver for £40 or if I cancelled the order there would be a charge of £65 for what they termed distribution costs which seems like another term for a restocking fee, which I think is illegal under the online selling regulations.
I cancelled the order as I did not trust them to contact me to confirm delivery, and I asked my credit card company to arrange a chargeback as I did not agree to the £65 charge. AC have now said they will refund the money less the £65. What rights do I have. I am still waiting to hear from the card company.

  • Did you officially cancel the order in writing citing the Consumer Contracts Regulations?  If you didn't you're beholden to whatever their T&C's are, which appear to include restocking and redelivery fees.

    If you're within the 14 day period they cite, better get that letter written.
  • Thanks for the reply. I cancelled it and objected to the charges but I was not aware you needed to mention the regulations. Seems a bit pointless to have regulations that only apply if you mention them.
