POPLA appeal - ParkingEye £100 fine for spending 10 minutes in a car park without parking.

    A quick update - my appeal was successful - thank you so much for your help

    On a related note, incase parking eye were not enough of a deterrent at the Lido car park -  the land has recently caved in

    Haha, never heard of ParkingEye being involved in a case where the earth moved!  Hope it gets cordoned off so no more victims park there at all and the ANPR cameras have to be removed.

    Nice POPLA result!  Fancy them providing a 5 year old Witness Statement from a landowner signatory who probably doesn't even work there now.

    Well, as I noted on 13th October; the 5 year old WS was in the wrong company's name anyway-but then again, POPLA has a history of "making things up".

    I have just had an appeal upheld by POPLA on exactly the same grounds, at the same site. I had an inkling there might be a landlord authority issue from my own research, then I found this thread and had it confirmed - thank you! 

    Our PCN was issued in October. From what I have read, the lease on the car park has been passed to a local businessman, but they are still relying on a dodgy Landlord authority, in the wrong name, from 5 1/2 years ago…

    I plan to raise this with the local MP as a minimum.

    Hi, just dropping a quick note to thank previous contributors to this thread, having had another appeal upheld at the POPLA stage for this site in Margate. In this case, my car was in the car park for a total of 6 minutes, which the assessor considered to be a reasonable consideration period.

    However, while the appeal was being handled, Parking Eye produced the same 'proof' of landowner authority as was given to @the_midnight_Wolfboy in 2021.It might help anyone else getting a NtK from this car park in future to know that the company giving the so-called authority on that document (Stour Side Investments) was dissolved in 2022 (see https://find-and-update.company-information.service.gov.uk/company/08589287 ), so I'm sure this would have been yet another reason for successful appeal, had the assessor needed to consider it.

    Hi I’ve run into this same issue and was hoping for some help on how to appeal! 

    I pulled into this car park at 10 past midnight, I saw no signs for parking restrictions as it was pitch black. I am currently pregnant and had some friends visiting from abroad who wanted to go to one more bar, I didn’t get out of the car as I was feeling unwell. I would have bought a ticket if I had seen a sign, I had an all night ticket from another car park a few 100m away and would have got another if I knew. I got a PCR for £100, for being in the car park for 14 minutes and did not get out of the car. 

    Do any posters have any advice? How do I get the info about the company being dissolved if that would help?

    Thanks for this! I was able to appeal the first step. They came back me to and said:

    You have stated that you were not the driver of the vehicle at the date and time of the breach of the terms and conditions of the car park, but you have not indicated who was.
    You have already been notified that under section 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this parking charge in full. As we do not know the driver’s name or current postal address, if you were not the driver at the time, you should tell us the full name and the current postal address of the driver.
    You are warned that if, after 29 days from the Date of Issue, the parking charge has not been paid in full and we do not know both the name and current address of the driver, we have the right to recover any unpaid part of the parking charge from you, the registered keeper. This warning is given to you under paragraph 9(2)(f) of schedule 4 of the Protection of Freedoms Act 2012 and is subject to our complying with the applicable conditions under schedule 4 of that Act.
    Please note, if you have made or wish to make an appeal on behalf of the driver, and you do not provide the full name and current postal address of the driver, Parkingeye will be obliged to deal with the representations made in your name.
    Parkingeye have placed this charge on hold for 28 days to enable you to provide the evidence requested. If this information is not provided within 28 days, the appeal may well be rejected and a POPLA code provided.



    I have been looking for advice on how to reply to this one but can’t find it so was wondering if anyone could help point me in the right direction. Thanks so much in advance.
