Refund after Refusal to Board - Lufthansa

Back in May, I bought a ticket with my UK Starling Debit Card in AED, to travel Dubai - Frankfurt - Malta.  I was denied permission to board, erroniously I believe, and they have given me a part refund.  They will not refund the last 850AED (about £150) and I have been in battle with them ever since.  I have supplied them with screenshots to prove that their own website said that transit via Frankfurt was possible even for non-schengen passport holders, so long as they met the requirements of the next destination, and I did.

As I paid with my UK card and I have UK (here more than 6 months of the year) and also UAE residency, do I have any recourse to chasing them through the small claims court in Scotland (where I reside).

    Why the partial refund, what's the reason for witholding some?

    If you were denied boarding incorrectly then you may be entitled to compensation under EC261/2014. Make a claim against them under that. Details should be on their website. Again though, they may not agree they incorrectly denied you boarding so may not pay compensation.  

    In terms of chasing the rest of your refund and/or compensation, I'm not sure of the practicalities of trying to take a German company to court via the UK court system. I know it was relatively simple when we were in the EU but no idea now. 

  • This was my screenshot taken on 22nd May.  The supervisor said I had to have an invitation letter from the Maltese embassy since I had a non-schengen passport; this was not true!

    the screenshot also states  - "The rule does not apply to passengers from virus variant areas"
    UAE appears on the risk list at that date https://www.rki.de/DE/Content/InfAZ/N/Neuartiges_Coronavirus/Transport/Archiv_Risikogebiete/Risikogebiete_2021-05-21_en.pdf?__blob=publicationFile so those rules may not have been applicable to passengers coming from Dubai
