    Hi Guys,

Just wanted to update you all. I followed the advice in this forum and can happily report that I won my case.

I filed a defence, DCBL rang a couple of weeks before the court date and offered to settle out of court, I chose to decline. Waited for the court date and they filed a N279 Notice of Discontinuance 1 week before the court date. They didn't even send me their witnesses statements by the date set by the court, so I wrote to the court and DCBL via email asking to throw the case out.

Once again thanks for all your help and support.
Great news - well done you! Don't disappear just yet though... And congrats...

    ANOTHER ONE BITES THE DUST!

Do get your revenge this Summer because £100 plus £60 or £70 is extortionate. It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it?

If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:
    https://forums.moneysavingexpert.com/discussion/6333989/mse-parking-ticket-appeals-guide-feedback#latest

    Read the latest there.

The PPC moneymakers have blocked the new Code with Judicial Reviews.  Stopped the declared and much welcomed parking code from February 2022, which stated that added £60/£70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50, like Council PCNs.

Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.

Don't leave it weeks (let alone months) without checking back here please or you might miss the final Consultation.

It is your chance to make a difference.

DCBL are dropping Autosec cases like hot potatoes - that’s at least 6 now in the last couple of months

Best plan appears to be sit it out and wait for the N279

Probably worried about getting paid, given that the accounts for Autosecurity Ltd are overdue; (that's a real fine of at least £150 coming their way).

I've now seen 3 (including my own) this week where DCBL have phoned to offer a settlement before issuing a N279 before the WS deadline. Seems to be their new tactic. Fairly minimal work at the end in the hope that the Defendant will be scared into settling.

I can only imagine they are having to tighten their belts. They are probably having to play wait and see with the result of the JR. If the JR puts the an end to the extra unlawful £60/70 then their business model is f**ked!!!  They make millions from coercing/ bullying and taxing people to pay this fantasy charge.  They pay people to basically bully customers over the phone to scare into paying this imaginary tax (created by Gary Osner of ZZPS). So that will mean paying off staff, downsizing premises, cutting assets etc.

Hopefully the Judge over ruling will violently kick away the trough from which they've been filling their fat snouts for all these years from!

With this cost of living crisis- £160/170 or even £60-100 doesn't go as far as it once did so I it's the choice of food shopping, petrol or bills - then people will naturally prioritise whars important - food, warmth, shelter, transport, water etc - not paying for some greedy ex-clampimg idiots' designer clothes, holidays, cars, moody investments or cocaine habit!!!  They've worked hard for that ££ and will work just as hard to keep it! DCBL know that this part of their business is in jeopardy as do many small to mid sized parking firms so they can't be so spiteful or frivolous chucking money on court cases they'll probably lose! I say GOOD 👍

No Judge is involved.  The JRs are paused because the Govt conceded they left some holes in the process.  So that's where we are.

It will ALL be down to the impact assessment. Based on the Public Consultation.
