I had a similar problem. I received a letter from HMRC informing me that I had a tax refund and the cheque was sent to Ensign Advisory. I couldn't remember signing anything but after emailing them (Ensign), they sent me a pdf copy of the agreement I signed. Not the brightest decision I have made as they take over 50% of your refund.
Hi Stephen, I am in the same position and urgently want to see the terms agreed to in this 'Deed of Assignment'.

Would you be able to send me this?
Stephen hasn't logged on since April so you unlikely to get a reply.

Contact Ensign Advisory for a copy of the deed.

The way these companies work ( there are several ) is they entice you to sign up with them to claim a tax rebate fo such as washing uniform at home, transfer of marries couples allowance.

However, the item that you sign is a deed that authorises HMRC to forward all further refunds to them.

Most people do not read that bit so do not realise what they are agreeing to.

This election will remain in force until it is cancelled.

By signing the Declaration to Act and our Letter of Assignment, in favour of Ensign advisory LTD, you unconditionally and irrevocably instruct HMRC to release, assign and repay to Ensign advisory LTD any tax rebate arising.

Although I don't think it can apply to future tax years.

Current advice is that Deeds cannot be open ended  but HMRC certainly considered early deeds as open ended and repaid later years to the company.

Ensign Advisory's deed is open ended as no year / time scale is stated
  • I managed to get my hands on my deed and it looks to be only for certain tax years.

Has anyone had any luck / know how I can cancel the deed? HMRC said I need a letter signed by both myself and Ensign stating that they are no longer my tax agent however I'm not sure how responsive they will be.

You are mixing two things up.

You can tell HMRC they are no longer your agent and they must stop sending copies of correspondence or disclosing your personal information to them.

But the way to stop the deed of assignment is for Ensign to also agree.  Otherwise you simply have to wait until those tax years are out of date (for example 2017:18 is now too old to claim and 2018:19 will be too old come 6 April 2023).
  • I myself have received one today for the name of Alan Paul Warren.  I don't know who that is, I've never dealt with this company,  but clearly there dodgy is hell.

Just to make sure I understand correctly.  If i tell HMRC  to stop disclosing my personal information to them, that implies that they can't claim anything in the future on my behalf?
What about anything that the government will discover in the future? Will they still have to send future tax rebate through them to me?

What year/s are stated on the deed.?

The deed will remain in effect for these years or until  the company agree to it being cancelled.
