Estate Agent lied about offer - said offer I got was 150k when the buyer was offering 160k

- 'I've paid the EA £10k which I don't believe was fair - how do I get it back?' Which I understand is the small claims court route to get it back. Also its not about giving the EA grief its about justice for myself and others, we dont think that just the fine alone is right and the EA should have been jailed but thats what the courts decided so what can we do. I am not sure if anyone has seen a similar case to this so I dont know what the punishment is for someone who does this sort of thing?

aoleks - I did not know he was a scammer or was banned no one did , also the fees originally on the contract were around 800 or so plus VAT, free solicitors etc and the performance fee.0

You've been advised multiple times that the answer to your problem is the small claims court to reclaim the £10K you've paid.Regarding the jailing, there is nothing you can do. As already explained prosecution is the responsibility of the authorities (police or Trading Standards) and is nothing to do with you. Likewise, sentencing is the responsiility of the courts, not you. It is not uncommon for victims of crime, who have emotional and subjective opinions, to disagree with a court's objective decisions.Edddy suggested earlier you could complain to the Property Redress Scheme. There are in fact two schemes:You should complain to whichever scheme the agent belongs to.However, I suspect he may not belong to either in which case I doubt they would accept the complaint.

If they weren't members of a redress scheme, I expect that Trading Standards would have prosecuted them for that as well.

Interestingly, if you read some of their 1 star reviews...You are pressured to write a review whilst sitting in the office....They have a chat with you for an hour and after ask you for your phone and write there own review...0 -
really highlights that you should read the T+Cs before signing anything. A performance fee should have been clarified and if it is open ended, walk away"It is prudent when shopping for something important, not to limit yourself to Pound land/Estate Agents"
