Envelope arrived but was empty

I won an item on Ebay and paid via Paypal.

When it arrived the packaging it was sent in wasn't sealed, it still had the "REMOVE TO EXPOSE ADHESIVE" sticker over the glue on the jiffy bag, so I presume the
item fell out during transit.

Went into Ebay to email the seller about this and it says they're no longer a registered user!!
I still sent a message to them explaining what had happened.

Should I wait and see if I get a reply, or just file a claim with Paypal?

    I would put in a claim anyway but seller is likely to have emptied their account.

    Was the weight or postal charge shown on the package,does it tally with the weight of an empty envelope or a full package.

    At my PO the guy spotted one parcel that I hadn't sealed and kindly taped it up for me so it could have been a genuine mistake.

  • I think the postage was about £1.60, so I'd guess it means it wasn't empty to start with.

    If they've emptied their account does that mean I won't be able to get my money back? :(

    I'm not sure to be honest,hopefully someone who knows will be along soon!

    The fact that they are no longer a user is a bit worrying though.

    If you get no response put in a dispute.

    Was it sent tracked or just normal postage?

  • Could you claim with the royal mail, for 'item missing or damaged in the post'? I know it technically wasn't Royal Mail's fault that the item went missing, as the envelope wasn't sealed, but it wasn't your fault either. Or you could contact ebay. If you paid via Paypal or a credit card, then maybe you could get a refund from them.

    given the item wasnt damaged then doubtful.
    rm are far more rigorous with claims nowadays.
    however as said its down to the sender to file any claims

    You need to file a dispute with paypal asap. Chances are he will realise his ebay account has been suspended so will try to get his money out of paypal.

    A paypal dispute should prevent him from clearing out his funds as once he has his money, paypal will be unable to refund you.

    It was a MP3 Player (an iPOD Shuffle look-alike), I paid £18 for it.

    I've opened a dispute via Paypal, how long should I wait before escalating it into a claim?

    The buyer can claim from royal mail also but you would need info as to when and where it was posted, I would ring them for more info
