    I am really concerned that this OP wants to pay an inflated hundreds of pounds to a parking firm AND £100 for a set aside with consent, when the PPC appear to have relied on an old address and not traced you properly before filing a claim.

    Now you should always ask a PPC first, if they will consent to a set aside, because that keeps the court fee lower, but pretty much no one also pays the CCJ.

    Why is your mind made up to do that?  What have I missed?

    f you pay this, be aware that at least one MP has linked thes companies to organised crime.  Do you really want to fund the importation of hard drugs, people smuggling, and modern slavery?

    To be completely honest with you I just thought that's what was expected of me if I wanted the CCJ set aside with consent. I wasn't aware that the PPC could possibly agree to set aside with me only paying the £100 court fee. I would have expected that they would at least want the initial PCN paid? (I'm not sure on the cost of this as no paperwork of course)

    @D_P_Dance I would really like to not pay this!! These companies seem so corrupt. I just really need the CCJ gone so feel a little desperate. Its taking a massive amount of time reading through the threads and working out what I need to contest it. Working & having a little one makes it really difficult to dedicate days/weeks to fighting them :(

    The PPC DPO has also got back to me requested additional proof of identity in order to get the SAR approved. I already sent them a scanned copy of my V5. This is what they said:

    The General Data Protection Regulations (GDPR) came into play on 25th May 2018 and replaced the Data Protection Act 1998 (DPA)

    GDPR gives certain rights to Data Subjects (DS) in accessing personal data that is about them or where they are identified.

    It also places obligations on Data Controllers (DC) in relation to the security of the personal data that we hold not to divulge this personal data to individuals or organisations that should not normally have access to it.

    We therefore need you to confirm your identity by providing us with two pieces of documentary evidence. We don’t need to see original documents (a clear photocopy or photograph of the document will suffice) and it is advisable to redact (blank out) any financial information that may be contained in the document.

    Some examples of documents we can use to verify your identity can be found below:

    Driving License.
    Passport.
    Utility Bill.
    Council Tax Bill.
    Mortgage or Rent Document.
    Bank Statement (or other financial statement)
    HMRC document.

    DVLA V5 Document


    When we receive your identity documents we will then collate any personal data we hold on you and will endeavor to provide it to you within the prescribed time-frame of one calendar month.

    We won’t retain these documents and will delete or securely destroy them once your identity has been verified.

    Your questions are answered in the Newbies thread section on set asides.  Of course you don't offer to pay the PCN claim amount as well!

    You need to read more set aside threads to understand why telling them that their claim was defectively served to an old address and they failed to comply with the CPRs and Code of Practice by taking proactive steps to locate you first, is enough for some PPCs to consent to set aside and start again.

    Then, once set aside, you defend and win, or sometimes they give up and discontinue.  Examples all over the forum!  Come off your little island of this thread and go read at least TWENTY threads with CCJ on the title (no links, they are on the first couple of dozen pages of this forum waiting for you to read them, until the penny drops on the stages to work through and why you don't just pay it!).

    Warning: be quick.  YOU MUST ACT PROMPTLY. 

    Give them a max 14 days to consent and make it clear what's in it for them (see examples on other threads).

    if they won't consent without making you pay the enhanced ludicrous sum(!) you will have to instead apply 'without consent' as explained in the NEWBIES thread (£255 court fee) which you then hope the Judge awards back against them for failing to trace you.  As shown in multiple examples of cases worked through and won.

    And to do it that way, the court says you must act PROMPTLY, so get that application in during October, no hanging about.

  • @Coupon-mad Thank you! I found a thread that gave a good example of a set aside with consent written by Henrik777! So I am just in the process of tailoring to my case & should hopefully have that sent off by the end of today.

    I also just got my SARS request back from PPS. It contains the NTK and the payment/driver identification form. As expected it has my old address on it, & was sent on the 03/09/20. I moved on 28/07/20.

    My question now is should I send a SAR to BW legal in order to get a copy of the CCJ docs that they should have sent to me?

    There were no CCJ documents and there is no copy if the claim form itself unless BW Legal create a copy for info.  If BW Legal were involved then send the set aside consent request to them for their clients to respond within 14 days, and also ask for a copy if the claim form submitted, or at least the Particulars of Claim and addresses used, and evidence of any attempt to properly trace you before the claim was filed.

    If it is not too late do not send any photo ID.  The PPC do not know what you look like so to what are they going to compare you photo?  Do they have a database of everybody in the country's picture?  If you send financial documents redact any account numbers etc.
  • @Le_Kirk Ah Damn was too late. I did redact any important info though!! So that's something. But now unfortunately they have a copy of my passport & bank statement. Although in their reply they stated they have deleted the info. Obviously they can't be trusted however!!
