  • Technically not, as my dad already had a permit to park in his own allocated space via the lease, it wasn’t possible to obtain a second permit for additional cars for that household.
  • Evening all.

    Just a small update:
    DCB Legal have responded in regards to the email I sent around the 19th October:

    DCB Legal note that you have requested evidence of the Parking Charge Notice (PCN).
    It is our position that the Letter of Claim (“LOC”) is compliant with the Pre-Action Protocol for Debt Claims (“the Protocol”). The LOC provides adequate information for you to identify the debt that our Client is seeking to recover. We respectfully draw your attention to paragraph 2.1(c) of the Protocol and remind you that both parties are expected to act reasonably and proportionately.The terms and conditions on the signs stated that parking was permitted for vehicles parked wholly within a marked bay. The vehicle was not parked within a marked bay as is demonstrated in the photographic evidence attached. The parking charge was issued correctly.
    Copies of the signs validly displaying the terms and conditions are also attached. 
    The PCN was affixed to your vehicle, and awarded you the opportunity to; appeal the parking charge, transfer liability to the driver (if it was not you) or make payment. Neither a successful appeal, nor an adequate nomination were received, yet payment remains outstanding. A Notice to Keeper was sent to you on XXXX. Copies of both are attached. 
    You have 30 days from the date of this email to pay the outstanding balance of £160.00. Failure to do so will result in a claim being issued against you without further notice.
    Payment can be made via bank transfer to our designated client account:-  
    Account Name: xxxxx
    Sort Code: xxxxx 
    Account Number: xxxxx 
    You must quote the correct case reference (beginning ‘10’) when making payment. If you do not, we may be unable to correctly allocate the payment. If further action is taken by us as a result of an incorrect reference being quoted, you will be liable for any further fees or costs incurred.

    This is similar(ish) to the response sesaide40 received from BW Legal.

    Though I feel as if they’ve completely brushed over the email I sent around this “claim is estopped under cause of action estoppel”.

    Can you advise what else I should do?

    Or would any of you like me to DM you the images/signage?

    Remind them about the fact of cause of action estoppel and say you will report them to the SRA if they persist with this second claim for parking charges involving exact same facts, car, location, defendant, etc.

    Just an update…

    Email received recently from DCBLegal:


    Further to your email dated XXXXXX (regarding how the claim is estopped under cause of action estoppel), where you refer to Claim Number XXXXXXX, we confirm we are not instructed to act in relation to that Claim Number.


    We will proceed as normal as per Client instruction.


    Does anyone have any other advice, or any other recourses / avenues to try and resolve before MCOL stage?
