If everything you and younger relative are saying is true then this car was sold to you with a defect which at MOT is classed as 'major'. Whether it was legal at the time of the 2020 mot is probably not relevant to the case but the fact that the selling dealer is also an mot test station does mean they had the skill and ability to check out the road-worthiness of the vehicle and emissions prior to sale.
It's utterly relevant to whether the test was done correctly or not.

But the time to appeal the test has LONG passed anyway.

So this is simply a consumer rights question, and the MOT is irrelevant to that.

I agree but the point I was making is as per your 3rd sentence so
Sorry I can't think of anything profound, clever or witty to write here.
  • Never buy cars where the previous owner has fiddled on with re-maps and de-cats and other questionable mods. They always come with problems.

What is the date of the last MOT compared to when your Younger family member bought the car?
Purchased March 2021. Last MOT was Oct 12th 2020.
So previous owner may have done the work after last mot then.

You all had me very worried about the stolen cats and sports cats and things being de-cats until I realised you were still talking cars and not moggies.

A Stage 3 head is a perfectly reasonable mod to make; it just makes the engine better.
However, if the car was being used for track events then it's entirely possible that the cat was removed; who knows if the exhaust was swapped back for the MOT.
An exhaust place should be capable of fitting a pipe & cat; presumably the manifold is the key part to keeping the performance.
OTOH, it might be possible that the previous owner still has the original exhaust and cat - it might be worth seeing if you can contact them?

Is the car dealer a performance specialist or a run of the mill dealer?

Easiest approach is to just get a new cat/exhaust fitted and move on with enjoying the car.

Might be better trying on the consumer rights board.

In my non-legal opinion that should be rectified entirely at the expense of the selling dealer but I don't count.
Even on the CR board you might get conflicting views and it's difficult to determine who actually knows how to apply the relevant law as opposed to think they know.
Thanks. I agree. The car isn't road legal without a cat. Even rally competition cars (which are allowed to have parts that they were fitted with from the factory absent and still pass an MOT ) must have a cat fitted.
