    Firstly PoPLA say...
    The appellant has identified as the driver on the day of the parking event. 
    They go on to say...
    After reviewing the evidence provided by both parties, I am not satisfied that the driver of the vehicle has been identified.

    Make up your mind PoPLA. Has the driver been identified or not?


    Under Schedule 4 of the Protection of Freedoms Act 2012 (PoFA 2012), it states that liability for unpaid parking charges can be transferred from the registered keeper to the registered hirer if “the creditor has within the relevant period given the hirer a notice in accordance with sub-paragraph (5) (a “notice to hirer”), together with a copy of the documents mentioned in paragraph 13(2) and the notice to keeper”....

    No, POFA does not say anything about transferring anything from the registered keeper to the registered hirer. What on earth is a registered hirer?

    They got the last bit right.

    As the Operator did not pass copies of the hire documentation to the appellant then clearly the hirer cannot be held liable.

    The assessor appears to have pressed a wrong button, you won.

    Is it headed up 'successful' or not?

    If not, then complain to POPLA (see their FAQS) about an 'admin error' as clearly the summary says the appellant hirer won.

    YOU MUST GET IT PUT RIGHT IF IT DOESN'T SAY 'SUCCESSFUL' BECAUSE THE PPC WILL PURSUE YOU.

  • Hello... me again (snore). 

    After our complaint to POPLA about our appeal saying 'unsuccessful' when it was in fact successful, we didn't bother contacting IP or the hire car company about the result, whilst waiting for POPLA to update the status. We've just come across two letters since that we missed, and weren't watching out for because all previous communication was via email!

    1. From the car hire firm saying final notice back in October. 
    2. a 'debt collector' company saying it had been passed over to them to deal with, with a deadline of 13th December (oops)

    From what I read, I shouldn't respond to the debt collectors. Should I just contact the car hire firm sending them a link to the popla outcome and inform them that we won't be making any payments to them and that they should chase the private parking company for money instead? 

    Don't want to put my foot in it!! Thanks :D

    Just copy the wording from the POPLA appeal, cropping off the top because clearly it was successful.  Send that screenshot to the hire firm and tell them the appeal was upheld and see decision attached.  There is no admin fee due in such cases.
    whilst waiting for POPLA to update the status.
    They won't unless you make a right pain of yourself and maybe get your MP to lean on POPLA.
