    Ok so copy any other NTH POPLA appeal. It's all been done before loads of times and you can copy their POPLA appeal wording.  

    Look back (from the final page, going BACKWARDS in time) for posts this year in the POPLA DECISIONS sticky thread where people have reported winning based on a Notice to Hirer POFA argument.  They will have linked their thread and shown the POPLA outcome.

    That can't be done on a phone and will take some reading to find decisions about hirer cases but they are there, I promise.

  • Back again..... Initial Parking have responded to our POPLA appeal with multiple defences but as far as I can see, still have not been able to identify the driver (not me). Should I highlight this in my response? I have 7 days to submit more comments. 

    Also, in the meantime, we've received an invoice from the care hire company demanding an admin fee for providing our address to IP. Should I pay or refuse on the grounds that we're appealing? Thank you!

    You must point out any of your arguments that the parking company have failed to challenge and indeed all those points that they have simply got wrong. This is all explained in the third post of the NEWBIES thread following the heading - AFTER SUBMITTING YOUR POPLA APPEAL:

    You also need to reemphasise that the PPC has failed to provide the required documentation with their Notice to Hirer - POFA paras 13 and 14.

    But keep in mind that you have less than seven days and must limit yourself to two thousand characters - not words.

    Is there anything I can do about the admin charge invoice from the hire car company or do we just have to pay them? They’re already suggesting further action when they only contacted us about the charge a couple of days ago!

    What does you contrsct with the hire company say about invoices from private parking companies for alleged breaches of contract.?  If it is silent write to them and demand a refund.  If they quibble complin to Trading Standards.  There is more information in other threads on here,  please read some.

  • We don’t have a copy of the contract - should I contact them
    requesting that specific section of their contract? 

    I’ve looked under newbies and can’t find anything specific about car hire admin charges. 

    Also, they haven’t charged us because the payment failed so they are chasing us to pay them and suggesting further action will be taken if we don’t voluntarily pay.

    Ask the hireco foer as copy of the complete contract  It will  almost certainly have NOT mentioned these invoices.

    “They” are the hire car company. I’m not sure if It’s wise to name them on the thread. They contacted us saying they’d tried to charge us but the payment failed, therefor require us to send them the money instead.

    Tell them you will "send the money" when they prove beyond doubt that they are due the money and they can do this by sending you a copy of the contract highlighting the part that gives them the right to charge you!  Bear in mind if it says "fines and penalties" it cannot charge you an admin fee as you have not received either, merely a speculative invoice from the parking company.

    PCNs from PPCs are simply invoices for damages for alleged breaches of contract.  Until a judge has rules no such debts exist.
