I’m in court tomorrow. JLA. No stopping. Let’s see what happens.
@deanclarke123, did you file and serve a witness statement and evidence?
There is nothing on your thread to suggest that you did.

OK so you have your deadline for your WS and evidence. You have a few weeks to work on it in March.

Make sure you include the new wording about the banned 'damages/costs' add-on, and have read the newly published statutory (Government) parking Code of Practice and understand how it assists defendants even in existing cases.

Adapt the WS examples from 2021, by @jrhys and @Nosy and add in the new stuff about this month's Code of Practice.

I've written a new section on that, as explained here with some very useful reading links for ALL defendants of a PPC claim:

    https://forums.moneysavingexpert.com/discussion/comment/79021699/#Comment_79021699

That link is on a thread where the OP is working on their defence (a stage which you are past) but you can adapt the wording for including in your WS bundle.

Hopefully yes, having had the above pointers in February.

@deanclarke123 isn't the OP of this thread, he just jumped in a couple of days ago and, predictably, has taken it off course.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Yes, I did realise that @Umkomaas.   ;)

But even looking at his own thread there are no indications that he has even filed a Defence, let alone a WS.

Hi everyone. I had my hearing today. I turned up to court to discover it was to be on Teams. Nobody told me... the judge allowed the claimant to make his case first. He did so. I was itching to get my responses in. But then the judge asked him a few questions about 'consideration' and then said to me: 'I don't need to hear anything from you, Mr ------, and I'll outline why I feel the claim has failed,' before going on to dismantle the poor guy's arguments. It all boiled down to the poor signage and whether it was the case that 'no stopping' applied to a portion of the road where I had pulled in - where there were no red lines - and whether it ought to then logically apply to a pelican crossing where the law required vehicles to stop. So I won! Without having to say a word. Slightly aggrieved that the witness expenses are capped at £95 (I'm a freelance and had to cancel a shift which would have netted me more than that in order to attend the hearing), but glad that VCS will have to pay it. A massive thank you to all who provided so much help and advice. Clearly, the days of these scumbags are numbered.
Technically, if the Pelican Crossing was on private land then the law of "failing to stop" doesn't apply to it; unless it was covered by a Byelaw. (However, the driver could still be charged with the offence(s) of Careless and/or Dangerous driving).

Would these be the signs so described by LJLA in there template response to any complaints about VCS..."There are over 80 high profile signs explaining the red route to drivers, all signage exceeds the recognised industry standards, with some as large as 2m by 1m on the airport approach road and surrounding roads."
    Well done on your win!

    Well done nice win. 👍

Seems that judges are getting increasingly hacked off with these unmeritorious claims clogging up the courts right across the country.
