I have now received a Notice of Proposed Allocation to the Small Claims Track. I have a questionnaire to fill in which asks whether I want to go to mediation. Is that a good thing to agree to?
This is also covered in a post by Bargepole ( or System ) linked in the second post of the newbies FAQ sticky thread near the top of the forum in announcements , as well as in the first post of the defence template thread by coupon mad , again in announcements at the top of the forum , those 12 numbered steps by coupon mad

So as above , are you following those 2 valuable resources for written advice ? Yes or no ?
Yes... found it. Thank you. I've filled in the questionnaire as advised. How do I serve copies on other parties? They've only send me one. When I return this to the court, will they file a copy with the claimant? Or should I get my form photocopied/scanned and send it to VCS directly?
Why not follow the guidance in that list you were using earlier?...

  • Latest development... I returned the questionnaire to the court and claimant. Yesterday I received a letter from VCS saying that Elms Legal had ceased to act on their behalf and they were pursuing the claim in person. They also sent an offer saying they'd accept a reduced charge of £185. If I refuse this, they'll continue the claim for the full amount (£245) and produce the letter to the Court's attention upon the question of costs.

They will probably struggle, tell them you will see them in court  and, when you have won, will ask fir costs under CPR27.14(2)(g)

Same as you will no doubt have seen on all the other VCS/Elms threads, of course.  Including one yesterday.

A sign of desperation perhaps.  Tell them to go forth and multiply.

OK so you have your deadline for your WS and evidence. You have a few weeks to work on it in March.

Make sure you include the new wording about the banned 'damages/costs' add-on, and have read the newly published statutory (Government) parking Code of Practice and understand how it assists defendants even in existing cases.

Adapt the WS examples from 2021, by @jrhys and @Nosy and add in the new stuff about this month's Code of Practice.

I've written a new section on that, as explained here with some very useful reading links for ALL defendants of a PPC claim:

    https://forums.moneysavingexpert.com/discussion/comment/79021699/#Comment_79021699

That link is on a thread where the OP is working on their defence (a stage which you are past) but you can adapt the wording for including in your WS bundle.

We are keen that all area Judges soon see and can exchange info between them, from a WS that includes all they need to know about the statutory Code of Practice.

    Thanks very much. Brilliantly helpful.

I've also received a letter from VCS 'mindful that under the Civil Procedure Rules litigants are expected to try an resolve disputes wherever possible'. Rather magnanimously, they're offering to accept a reduced settlement charge of £192.50. They will bring this letter to the court's attention if (when) I refuse to pay it.

Standard stuff. Stay with the game, you could be on the road to a disontinuance. Can't give guarantees, but lots of PPCs (including VCS) do discontinue where the defendant doesn't wobble.

Even if this went to court, and lost, the cost order would only be fractionally above that offered figure - maybe £220.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
