Thanks so much for all the brilliant advice above. I had a breakthrough yesterday where they emailed to say I was correct in informing them they have to issue a refund within 14 days, so they are going ahead and processing it. Hopefully this means they will think about updating their policy, as it’s been made clear to them their current one is unlawful.4

Good result. I hope the pay up.0

Call me cynical but I suspect they already knew the law and are just chancing it. Many won't argue, of those that do many will give up once they face the slightest resistance. There's effectively nothing to lose by doing this. Anyone who is persistent enough gets an "oops you're right" and a refund. They get to hold onto the rest.liv2909 said:Thanks so much for all the brilliant advice above. I suspect you're right. I'd report it to Trading Standards on the basis that I doubt they'll make any changes to their website.y3sitsm3 said:

Returning to an earlier post, and whether this repeated sort of behaviour might constitute a criminal offence, I think that what unholy_angel used to refer to was this stautory instrument.
The Consumer Protection from Unfair Trading Regulations 2008 (legislation.gov.uk)
I think it replaces the old Trade Descriptions Act and makes certain business practices criminal offences (enforceable by TS) insofar as they attempt to restrict stautory consumer rights.0 -
Yeah - hope they are OK.soolin said:
Just picking up on this, it’s the longest they have gone without posting, I hope all is well I might send a message.Jenni_D said:Tagging @unholyangel in case she wants to chime in. (Not sure if she's still around here - not seen her posting for a while - her profile shows Last active: 30 July at 1:33PM).
They were very good at unravelling and analysing complex situations and also at giving very clear and concise explanations.0 -
Based on the spelling above, I may have tagged the wrong person. Is it spelled with an underscore? (I can't find a username with that spelling).Jenni x0

I think I'm wrong and you're right. No underscore in unholyangelJenni_D said:Based on the spelling above, I may have tagged the wrong person. Is it spelled with an underscore? (I can't find a username with that spelling).0
