Ownership of alleyway

Hi,
It seems there there is an alleyway behind my back garden which is accessing to the parallel street. However, the neightbour said that they own the alleyway with 2 houses and we cannot use it. He was not really sure when he talked and I checked their land registry records, and it does not say anything about the alley. How can I check that who owns the alleyway?

You'll need the title plans for your own and your neighbour's properties to see which title encompasses the alley within their red outline. There also may be colouring on the title plan indicating that other properties have a right of way over it. The title register for your own property will state whether there are rights to pass and repass over this this. If it doesn't state anything, then assume you don't have any rights.1

my property tile does not say that I have a right. Similarlay, the neighbourhg who told me this morning that I do not have the right to use, his title does not say either. However, some of them mentions about it.0

If this is the neighbour who told you this morning that he owns it, he wouldn't need a right of way to cross his own land. Does his title plan show the alleyway within his property red outline?0

no, his title does not say anything about it. his border does not cover it.0

I do not think so, The sideway between my house and next door is not owned by either of us. I assume there are a lot of places like this in our area. I will talk to land registry and council.0

Why do you want to know who owns it?0

Do a 'map enquiry' to identify all the titles in the immediate area. Then download the Plan for any that appear to include the alley.If you find a plan that does cover the alley, then download the title to identify the owner.

Someone owns it! Ownership may be unregistered though, or it may be council owned.
