CCJ from CPM - help please to set aside

Hi Everyone. I have been lurking and researching since yesterday regarding my case. Basically it is about a CCJ sent to my previous address from CPM for parking in my space in a residential estate. The issue is that the parking permit slid off and is only 3/4 visible in the dashboard. This happened in 04/02/2020 then another on 06/02/2020. After being directed to this page I was ready to fight them off in the small claims court. I did make an appeal initially but as you already know they were going to deny it. 

By March 2021 we have moved house. I have updated our proof of address including V5, drivers license, bills except the electoral register as we are not British, just settled status. Just the other day when I was trying to open an ISA account for my daughter, Wealthify informed me that I have a CCJ against my name. Now as we all know it gave me 2 sleepless nights as I don't want a stain on my credit file. So yesterday I checked with the county court and it is indeed for the parking charge notice that CPM issued to me. I now know that i need to file N244 which I plan to do come Monday as I wont to read a little bit more over the weekend for my next course of action.

For now I have requested a SAR from CPM. My first question is they want my address. I am now hesitant to give them my new address in case they do something but I do not want to lie in case it goes against me. Do I give them my new address or use my previous address?

Also, am I right in thinking that alongside my N244 is a witness statement? I am also going to ring County Court to request a copy of the original court claim via email. 

Thank you guys. I know you are a helpful lot as I have read in all your posts.I could not afford a solicitor at the moment and I feel you know more about these things.

    You have 2 different parking companies listed above and in the thread title , only one acronym is correct , so I suggest that you not only give us the correct acronym and full name , but after 20 posts you edit the above and fix the errors too , clarity is key here

    There is no company with the initials UK PCM

    Read the second post of the newbies FAQ sticky thread near the top of the forum in announcements

    And read the CCJ set aside saga by Olive_j too

    You must give them your name and address , plus add copies of 2 recent redacted utility bills as proof of I D under the GDPR law

    They cannot correspond with you without you proving who you are under data protection rules , so I D is a must , but no photo I D , no passport or driving licence

    Give your new address ( plus previous address because you require it to be erased in favour of your current address ) , plus the VRM details of the vehicle that was involved too

    thanks for the prompt reply Redx. In my haste, I have given them my passport as proof of identity. That was really silly of me then. Too late for that now unfortunately.

    I have read through the newbies thread, olive_j and that of sebastian but will run through them again once more in a better state of mind coz i did read through them but not digesting all the info coz of the stress of finding about the ccj. I will thoroughly run through them again this time and take notes. 

    Also sorry for confusing you. I have updated the thread title and the content. My parking issue is with CPM.

    Ok , so it's UK CPM then , an IPC member

    Decide on if you are trying to obtain a £100 with consent set aside , or a £255 without consent contested set aside , to start with , ensuring that UK CPM have your full current up to date address

    Of course you give them your address and you need to act promptly for a set aside, getting your application in this month.

    I am astonished you didn’t think to give UKCPM your address when you moved, and didn’t think they’d issue a claim even though you were here on the forum all along.  This is basic stuff and a court claim was always going to happen from this lot!  You only had to tell them your address at the time.  They can’t access DVLA data twice.

    I have decided to go for the £255 set aside without consent and I have already emailed UKCPM with regards to my updated address. 

    To Coupon-Mad:
    Yes I will try to sort everything out and file the set aside within the upcoming week.

    To be honest after moving house I totally forgot about the parking penalty as I was on the last trimester of my pregnancy then.

    For now I will go back to Olive J's thread and keep notes so I can start on my N244.

    Shallow threats and outright threatening lies are a standard working day characteristic of the scamming PPC,s and the bottom feeding legals...all for ones own financial gain of course ,

    These people have no buisness in private car parks, read these, google "priomacy of contract",  and complain to your MP.

    Ones actions in dealing with a PCN must consider what your time is worth. The hours spent on this forum dealing with a PCN that has got out of hand need to be considered. Hours that you could either be working more productively or enjoying a well earned break from such work....not fighting CCJ's and claims, with the Parking companies holding the threat.

    There are three ways.

    1. Do not pay the charge and await the Parking operator to commence a claim.

    2. Pay the Charge and forget about it.

    3. Pay the charge under duress and without prejudice and then prepare your claim against the Parking Company to recover the excess charge in a MCOL action.
