PCN Britania parking Poole

Hi I went to poole harbour and at this carpark saw people crowded around the payment machine saying it was faulty, others were having issues getting through over phone and paying online. I followed the pay online instructions and it confirmed I had paid successfully. I heard nothing after but recieved a PCN. I checked bank statement no payment went out. But I was never notified of any issue. I submitted an appeal making them aware I did everything to make payment. Have heard nothing back as yet. I have emailed the CEO to cancel the PCN or charge me less. But in worse case scenario what are we looking at? E.g ends up increasing amount goes to court, ccj on property, cat n mouse with bailiff firm etcetera, any other consequences? Is it worth the stress and hassle, should I just pay it?

  • Is there any other options? Can I get cctv footage under data protection act and details of others having same issue under freedom of information act? Would court chuck out unreasonable charge as firm not occurred these costs? Would I win POPLA appeal? Showing I tried to settle the charge?
  • How many years do ccj last? How many years can they pursue me?
  • They can pursue a "debt" or in this case a disputed invoice for 6 years from the original date (can't see as its blanked out) .  Not too sure how long a CCJ lasts, better not to get one - even you were to not win in court so long as you pay up in 30 days of a judgement its not a CCJ - and you would still pay a lot less in court than what the PPC and their Debt/Legal crawlers are trying to extort from you.

    You are not going to get a CCJ.  Read the NEWBIES thread.

    Why not complain to the BPA as well, on two issues:

     - the payment methods both failed for everyone that day but Britannia has issued PCNs anyway

    - this is a Harbour, comes under Harbour Byelaws so it isn't 'relevant land' but Britannia are unlawfully citing the POFA 2012 and keeper liability and misleading registered keepers.

    You do need to read the NEWBIES thread and any other Harbour threads and not say who was driving in any complaint and appeal.

    PPCs hardly ever cancel PCNs
    You never know how far you can go until you go too far.

    Certainly your chances of winning the case are reduced if you have told the parking company who was driving.

    The point being made was that because this land is controlled by Bye-laws, then there is no way that the PPC could transfer any driver's liability to the keeper.

    You have binned the winning point about byelaws and lack of keeper liability, as people always do when they rush to appeal before coming here...sighs with frustration... but there are other appeal points - and you certainly don’t pay!

    You will have to show evidence to POPLA that you instigated a payment and Britannia rejected it.  We see this a lot.

    Ring your bank and tell them about the confirmed transaction you saw and ask them to please give you evidence by way of a system screenshot that shows that the payment was rejected by Britannia or their agent.

  • I have since complained to the BPA and recieved acknowledgement, nothing from Britannia or their ceo whom I have emailed separately advising my statement of events was from the driver and I am appealing as keeper but my bank have confirmed there was a dummy payment of £0 made but no full payment was taken there on, they gave me an authorisation code, does anyway know how I would use this information?
