    She's wrong. Wait 16 days from that date and email in the N225 (marked URGENT - DEFAULT JUDGMENT SOUGHT) then phone the useless CNBC again to push it under someone's nose.

    @troublemaker22 has done a couple of counterclaims recently and the courts do put up ridiculous and unacceptable barriers to stop people getting default judgments.

    The claim WON'T be struck out. You have to be proactive because the CNBC will do absolutely nothing about it, if it's not a defended counterclaim.  Defendants are certainly treated like second class citizens.

    Regarding the N225 Form. Is the below correct?
    Section A - tick both boxes 
    Section B - tick the first and last box
    Section C - tick the second box 'Defendant’s date of birth is not stated in the form of reply....'
    Section D - tick the first box 'immediately'. Amount of claim as admitted £500. Do i leave the rest blank and then write £500 again in the 'Amount payable by defendant'

    If you tick both boxes in A (right answer) you must leave B blank.  These are not trick questions, they mean literally what they say.  The opening statement in B ('The defendant admits that all the money is owed') can't possibly be true if your answer to the first box in A ('The defendant has not filed an admission or defence to my claim') is true (which it is). 

    @Coupon-mad is correct.  Why would you not claim your court fee in the space provided at Section D?
  • @troublemaker22 Genuinely appreciate your time and help with this. I have filled out the N225 form and e-mailed it to my local court and ccbc. I will contact ccbc tomorrow and keep on top of them.

    That doesn’t sound right. If it’s already been allocated to your local court, why would you contact CNBC?

    Morning All,

    I just contacted the CCBC, @troublemaker22 you are correct, unfortunately, the case handlers are clueless. This woman told me that the time starts when you send in your defence/cc not when we process it, whereas the previous woman said the opposite.. Anyway, she said that the case is still with them, it hasn't been allocated to a court. She did say that this case is actually with a manager and that means it is urgent/priority and should be dealt with quicker than if it was not. She said to sit tight and the manager will contact me via e-mail. 

    I'll use the link @troublemaker22 you previously sent to file a complaint. After that, I guess it is a waiting game to hear back from them.

    Just thought I'd keep you guys updated. Hope you're all well.

    Hang on, did she say the N255 has been passed to a Judge?  If not, why not?

  • Hi Guys,

    Just a quick update. I just got off the phone with CCBC and they advised that my case was transferred to my local court/a judge last Thursday. I have already sent off my N225 form and filed a complaint online before the court received my CC. This morning, I resent my N225 Form again to the court. Is there anything else I need to do?

    Yesterday, I received a letter from the court to complete and return an N180 form (this is for the defence).

     Regarding the requested tenancy agreement, should i send it to them now?
