She's wrong. Wait 16 days from that date and email in the N225 (marked URGENT - DEFAULT JUDGMENT SOUGHT) then phone the useless CNBC again to push it under someone's nose.
@troublemaker22 has done a couple of counterclaims recently and the courts do put up ridiculous and unacceptable barriers to stop people getting default judgments.
The claim WON'T be struck out. You have to be proactive because the CNBC will do absolutely nothing about it, if it's not a defended counterclaim. Defendants are certainly treated like second class citizens.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad is correct as ever. The claim and the counterclaim are effectively two separate cases. In the claim, the ppc is the claimant and the motorist is the defendant. In the counterclaim the roles are reversed. Right now you should be focused on getting a default judgment on the counterclaim and ignore the claim and DCB Legal’s document request for the time being. As soon as 14 days (not working days) have elapsed from the date of service of the counterclaim without receipt of a defence to the counterclaim, you should send the completed form N255 by email to the court (as to which court, see below) with an email marked urgent with this header ‘case reference [ ] urgent request for judgment on the counterclaim’. You can download the form here:
https://assets.publishing.service.gov.uk/media/602a58e9d3bf7f031ce135cd/n225-eng.pdfComplete it on the basis that the ppc is the defendant and the motorist is the claimant. If the case has already been allocated to a local court, look up the email address and phone number here - https://www.gov.uk/find-court-tribunal and be prepared to call every day to chase up the judgment and also to lodge a complaint (see below) if you don’t get the judgment within a day or two.If it’s still at the CNBC, be prepared for a bumpy ride. Your email should go to both these addresses CCBC@justice.gov.uk and CCBCAQ@justice.gov.uk which will ignore your email for weeks if not months on end. You can phone CNBC to chase it up but the call handlers are clueless and take ages to answer the phone anyway, though it can be better if you call at 8.30 am when lines open. I suggest making just one 8.30 am call to 0300 123 1057 and if it does not produce a result (it won’t) go straight to the complaints form - https://hmcts-complaint-form-eng.form.service.justice.gov.uk/?analytics=rejected
Once the complaint has been lodged things should move along more quickly.5 -
Hi Guys,
@Coupon-mad Thank you once again for your help.
@troublemaker22 Thank you for your input. Very beneficial and i will do everything stated in your message.
Regarding the N225 Form. Is the below correct?
Section A - tick both boxes
Section B - tick the first and last box
Section C - tick the second box 'Defendant’s date of birth is not stated in the form of reply....'
Section D - tick the first box 'immediately'. Amount of claim as admitted £500. Do i leave the rest blank and then write £500 again in the 'Amount payable by defendant'
Thank you @Coupon-mad @troublemaker22 and the community for all the help. Truly is appreciated0 -

@Coupon-mad is correct. Why would you not claim your court fee in the space provided at Section D?

@troublemaker22 Genuinely appreciate your time and help with this. I have filled out the N225 form and e-mailed it to my local court and ccbc. I will contact ccbc tomorrow and keep on top of them.
Thank you once again. I will keep everyone posted.0 -

Morning All,
I just contacted the CCBC, @troublemaker22 you are correct, unfortunately, the case handlers are clueless. This woman told me that the time starts when you send in your defence/cc not when we process it, whereas the previous woman said the opposite.. Anyway, she said that the case is still with them, it hasn't been allocated to a court. She did say that this case is actually with a manager and that means it is urgent/priority and should be dealt with quicker than if it was not. She said to sit tight and the manager will contact me via e-mail.
I'll use the link @troublemaker22 you previously sent to file a complaint. After that, I guess it is a waiting game to hear back from them.
Just thought I'd keep you guys updated. Hope you're all well.0 -

Hi Guys,
Just a quick update. I just got off the phone with CCBC and they advised that my case was transferred to my local court/a judge last Thursday. I have already sent off my N225 form and filed a complaint online before the court received my CC. This morning, I resent my N225 Form again to the court. Is there anything else I need to do?
Yesterday, I received a letter from the court to complete and return an N180 form (this is for the defence).
Regarding the requested tenancy agreement, should i send it to them now?
Thank You0
