Chargeback on debit card for criminal builder

Options
I have had building work done that cost me £12,500, and have since found out that the builder is a criminal and has a record of conning people out of money.
Now the building work has started leaking water, obviously we have been told a wall should have drainage holes, ours has not, plus the job isn't finished, and we will have to claim off our insurance.
I have made a complaint to trading standards and because the builder kept coming back for more money, I had to let the police know, and he is forbidden to come to my door or ring me.  The money that I paid out was my retirement lump sum and it was for building work that my home needs to keep it in good condition.
Could I get my money back through Section 75 Chargeback, has anyone tried this.
I paid it into his personal account, but I had no choice as he wouldn't even move the rubbish or tarmac the driveway.  It has left us with absolutely nothing to repair the house or repair the job that he messed up.

No. Section 75 is for credit cards.

Chargeback applies to debit cards (as well as credit cards) but it doesn't sounds as if you used a debit card, if you paid it directly into his account. Was it in fact a bank transfer?
  • I seen somewhere on the forum an email for Section 75 claims, but cannot find it.  Does anyone still have it?

    Many thanks

You can claim back on a debit card, plenty of people have.
  • You'd contact your credit card provider for a s75 claim.

But that's a chargeback, not a Section 75 claim (which is not a chargeback.)

As zx81 has already pointed out you "paying directly into his personal account" sounds an awful lot like a bank transfer.  You don't pay money into people's personal accounts when you pay via a debit card.
  • I was a victim of a scam.

Well, you were more the victim of a shoddy tradesperson but either way, it doesn't matter. If you paid by bank transfer you're stuffed.
  • Do some research on FOS and WHICH etc, you will find out that you are not STUFFED

If you paid by bank transfer you're stuffed. The FOS won't help you.
  • They will and have helped a lot of people get their money back, read the cases on their website, otherwise please don't say that I am stuffed.
