Many PPCs take it to the hearing. A few bail out very close to the hearing. CEL are one of the PPCs that often bail out close to the hearing date when they realise they stand a good chance of losing. You are right to keep going on the assumption they will continue, but keep your fingers crossed as well.I married my cousin. I had to...I don't have a sister.

Recent WS examples are by @jrhys and @Nosy but also include the new stuff about the DLUHC's code of practice, as seen in Feb 2022 WS.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry, you've lost me a bit here. What's a WS and DLUHC?Coupon-mad said:0 -
WS = Witness Statement.
Google knows what DLUHC stands for.

So does searching the forum which would find the exact info you desperately need to read! If you've been away from the forum and missed the good news last month about the new Code of Practice and banning of debt fees, you need to read it.
CEL will pay the fee. Your court hearing Order wording is standard.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That, to me, sounds like a World Wide Web Consortium (W3C) guidelines breach: I'm sure those say that a website user should be able to access a site using a browser of their choice, but it's only guidance.Gnomi777 said:Okay, I'm in! You have to use Explorer...!
However, you only get 122 lines in which to submit your defence. This is not enough to fit in everything that is in the draft defence...1 -
I've just checked with the court and apparently the hearing is going ahead tomorrow morning at 10am...Fruitcake said:Many PPCs take it to the hearing. A few bail out very close to the hearing. I'm a little freaked out now...
I submitted my witness statement (using the brilliant 'template' suggested), which clearly notifies them that they are in breach of the Equality Act 2010, in applying the same rules to a breastfeeding mother that would apply to other members of the public. This is what I will stand by, as well as the shoddy signage. But I am a bit nervous of attending, if it really does still go ahead...2 -
Probably CEL is freaked out as well as they are dealing with the Equality Act 2010
CEL can pull out at the last minute or even not turn up
Go to the hearing if nothing is heard, have a crib sheet ready to remember all your points.
If the fail to turn up then they have acted in an unreasonable manner and you can ask the judge for costs awarded against them
If it all continues, when you win you can also ask for your costs4 -
There isn't a witness statement template. There is a defence template but the forum makes it clear that is not your only job.Gnomi777 said:

There are WS examples in the NEWBIES thread and tips about evidence to file and serve. Hopefully you did that last month? Witness Statement stage was when you needed to come back here (in June) and file and serve your evidence and witness statement (which was not the same as your defence).
I hope you did file and serve a WS and evidence but it's worrying not to have seen you back here to work on that stage, when you got your hearing date.
Let us know how you get on! Too late to file evidence now, if you haven't already.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I submitted my WS within the 14 days, including photographs and evidence, and referencing the errors in the claimant's WS, including the signage, as per the recommendation under the NEWBIES thread. I used the 'template' that the link under the WS section of the NEWBIES thread took me to. I've done a few witness statements for other things (including some horrible stuff that is going on at the moment, hence the lack of posting in here as I just don't have the capacity), and it followed what I'd expect to need to include.
Hearing running late, as they didn't have the Applicant's WS, so the Judge is reading it now. The Court Usher also commented on how terrible the parking is at Newbury Retail Park! Her grandad also got a fine.5
