Premier inn- heat complaint

Hi, any advise would be gratefully received. Sorry bit of a long story 

 In July my family and I stayed at a premiere inn for five night.  We had a major issues with how hot the room was. To give you an idea to temperature display in the room showed 28 degrees each morning. We where provided with 1 fan. 

I barely slept and after the second night went down to reception to talk talk to them. They said “it is a hot hotel” and gave me a card to email. They where not able to do anything but suggested if I contacted the people on the card they would be able to help.

so I did contact them and the automatic reply came back saying they would be in touch within 28 days. For the following three nights I did everything I could to cool down and eventually slept due to being totally exhausted. During this period I was leading at a youth camp nearby and therefore there was no option to leave as I needed to be there.

by the end of the week I get very ill and was really struggling. The week ended and we left.

4 weeks later I finally got a reply to my email saying they acknowledged my complaint, where sorry but would not be able to offer any kind of refund due to the terms and conditions in there good night guarantee
which says-


Our Good Night Guarantee does not apply where you do not have a great night's sleep due to (i) circumstances arising from the lack of a facility at a hotel where that facility was not included in the facility set of the hotel displayed or communicated to you when you made your booking (for example, due to hot weather and a lack of air conditioning, you did not have a great night’s sleep, but air conditioning was not listed as a facility at that hotel in the booking process – so please carefully check the facilities at your hotel when booking); 

I pointed out to them that this particular week we where there was not a heat wave and in fact it was raining a couple of times during the week.

I appealed and they declined, so I asked it to my raised to there management but they also declined. Saying the case is now closed.

my query is, now what? Do I have a case? I’ve read things about claiming from my credit card company, my holiday insurance or even a small claims court. But if I do have a claim where do I start?

    Clearly booking a hotel room that doesn't have air-conditioning in July is taking a risk that the room might be hot. If the weather had been hot, you would not have a case. I think a judge in a small claims court might reduce or reject a claim because the chance of it being hot in July was substantial, and it was just chance that it was not hot. 

    To make your case, you would need to argue that it was not hot weather, but the design of the room that caused the uncomfortable temperature. The fact that the staff know that it is a "hot hotel" suggests that Premier Inn should have been aware of it and that it is structural. 

    You have not actually lost any money, which means I think it is unlikely that your Credit Card or Holiday Insurance will be willing to help. 

    If you have Home Insurnace, check to see if you have legal expenses cover, and if you do, give the legal helpline a call to ask if you have a case for a partial refund based on your discomfort.

    We stayed in a hotel in London when it was over 30 degrees outside. during the day.

    Due to a statue outside the window , it could only be opened an inch.

    We were given a fan and we ran the fan 24/7. We left it on when went out  during the day and on all night.

    It helped make the room less unbearable.




  • If the hotel hasn't got air conditioning I think there is only so much that can be done by the hotel like providing fans . In summer if the hotel doesn't have air conditioning it's a non starter for me. My friend flat is like a furnace , in the last heatwave he booked into a premier Inn with air conditioning just to get respite for a few days he said it was worth every penny.
