The parking company sends the letters to the address on the DVLA database , same as police and councils !Potts_123 said:@redx sorry, i meant to say home address, not email address. so the notice to keeper and any subsequent letters were never delivered to me, they went to other addresses that i once lived at.
It is your legal responsibility to keep the address up to date , the DVLA can fine you up to £1000 for not doing so !. Therefore if anyone is to blame for that , it's you , so I wouldn't be shouting out about it !
If the PPC issued the letters to the address on the DVLA database , they acted legally and correctly , so pointless complaining about it or drawing attention to it. For all we know you may have outstanding council PCN s , bus lane violations , red route penalties , congestion charge notices , dart charges or police speeding notices ! As well
Please confirm that you have read and fully digested that template DEFENCE post , including the numbered steps !!1

i have indeed now i read it, thank you.
should i delete #4 which says
'It is denied that the Claimant has complied with the Protection of Freedoms Act 2012 in terms of 'adequate notice' of the parking charge on plentiful and prominent signs, and in terms of the wording of their Notice to Keeper which fails to state the correct period and warning about liability. The Claimant appears to be relying on presumption that the registered keeper was driving but on private land there is no such lawful presumption and the Defendant was not driving.'
as now looking at the photos, the driver is parked directly in front of one sign that is eye level, and another close by which is clearly visible. The wording on the NTK also appears to be fine, can someone confirm this for me?

VCS never comply with POFA and haven't done so since it's inception in October 2012
There is no POFA warning on what you showed us above, so the wording is not fine !
A driver may be liable ,. Keeper may not be , so leave POFA in2
-
Of course that's non POFA, look at the wording, it says they are going to try to pursue you on the assumption you were the driver...
...rebutting that presumption is exactly that wording I gave you and you want to delete it?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

........ and for the purposes of parking issues, the address they use is the one on your V5C not your driving licence and it requires two separate notifications to the DVLA.Redx said:

i feel very stupid asking this, having already dealt with this claim form and the relevant steps, but what happens if i miss the date for an AOS?
i have just submitted my AOS for another claim that i received but have realised i have missed the 14 day deadline, dont ask me how!
Is there a way i can rectify this?
it was actually sent to an old address of mine, the issue date was 08 Sep 2021, but i didnt receive it until much later once it had been forwarded on to me.
 any advice would be appreciated.0

            Issue date 8th September , AOS deadline is 19 days later , 19 + 8 = 27 , so that's today at 4pm , so no problems
Login and check the MCOL claim history
You can see the deadline date by KeithP in this thread1
