Personally, I'd never have parked there and would certainly never have assumed the car could be left there overnight, but I avoid private car parks if possible, due to the ex clampers infesting them.  When you know what we know you don't use car parks with cowboy firm signs up.

You should get confirmation by email from the Church that she was authorised but that will be needed at witness statement and evidence stage.  Later on in the process, as the NEWBIES thread 'know what happens when' explains.

this is the problem. i dont actually have any evidence, other than my wifes word. it was just under 6 years ago and im pretty sure its not even the church anymore.
i can prove the remembrance service was held there that weekend but thats it. so really its my wifes word against VCS. do i even have a leg to stand on?

another point, my car and driving licence was still registered to my parents address at the time so notices and letters were being sent there, and once they did get an address for me i had already moved on to another property so my tenants were receiving them. they were forwarding them on to me but is there a way i can use this?
ive had 4 addresses since the date the PCN was originally issued and to be honest i cant remember whether ive ever actually received any correspondance to my own current address or not, or whether it was all previous addresses and then forwarded on to me.

as mentioned earlier, i now realise how stupid ignoring these things were, i have just been forwarded another county court claim form for another ticket my wife received from a private company that she also chose to ignore, almost 6 years ago aswell.
i take it they are just trying to get in as much money before their time runs out?

You would be well advised to inform the PPC (send an e-mail Data Rectification Notice to the DPO) informing them of your "new address for service" and require then to inform all their agents and sub-contractors and also to ERASE all your old data.

You do not have to prove anything, that is for the claimant  The judge will have t decide OTBOP whether your wife is elling the truth or not.

Your wife's word plus proof of the remembrance service will be evidence!  That all cones later.  Why do you think you have no leg to stand on when VCS don't use the POFA so can't hold you liable?

I gave you that sentence to add!  Why do newbies always think their  defence is hopeless when we've given you wording that shows it is not?  Get confident.  We win these cases.

Start a new thread about the new claim from the other parking firm.

thank you all for your responses. when this is the first time you have had to deal with this stuff it can seem quite daunting, but ill move ahead with confidence. just to double check before hitting send, #2, #3, #4 are all good, and every other point on the template just moves up a number? no need for me to remove any other point stated from the template?

also, should i add a point in my defence about them never having my correct email address so there has been many letters from them that i have not recieved?

sorry for the bombarding of messages this morning i have also just seen that i have received a response from the DPO with all the photos and signage that they have of the vehicle, will this change my defence at all regarding POFA?

No idea because you have all the data and we don't , so check for POFA compliance or not and if necessary alter your Defence if required , so only change it if something jumps out from their data that means that it needs changing. You have the pictures etc , we don't

Not having your email address is irrelevant , it's for you to provide it , not for them to find it

As for the CCBC email address , everyone complains that they cannot find it and yet it's contained in the 12 numbered steps you should be studying in the first post of the template defence thread by coupon mad , in announcements

As for renumbering , it starts at paragraph 1 and ends at the last paragraph , which could be 18 or 23 , or even 30
