Advice/help - faulty car / consumer act 2015

    Why are you even bothered about getting the repair costs at all, you should be getting the dealer to sort the car for you.
    They asked her to in the 1st post - I guess they are considering paying a local garage to sort it rather than getting it back to their garage.

    Have you got it in writing to drive it to the local VW garage? You don't want to be in a position that the engine is damaged due to driving it then they turn round and say that's your fault.

    Although the fixes might be straight forward don't lose your right to reject the car. Given that the air-bag light is permanently on, the indicator has a problem and this issue with the coolant light, it does make me wonder what, if any, pre-sales checks were carried out on the car. I think it would be reasonable to ask for them to pay the VW garage to carry out some sort of pre-sales inspection or a service prior to handing it back to you.

    If it's been  bought through a 3rd party website where all the cars are supposed to have a multi-point inspection etc etc then it might be worthwhile. When this is sorted please do name the seller as it seems that they might be sending out unprepared cars to save money then just fixing issues as they crop up if the buyer notices them.

    As far as I can google, on an Up! the temperature warning lamp is next to the oil can symbol, on the main speedo to the left of 100mph. It flashes crazily when the engine is about to fail, and then you have to stop. It should come on with the bulb test when you first turn on the ignition.

    Is the symbol at the bottom something to do with the posh MFD, to tell you it is engine temperature that is being displayed, rather than outside?

    There is definitely something wrong though as the yellow engine light is on, and the SRS/Airbag warning.

    You can download a handbook from VW if you type in your VIN number

    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
  • The best thing would have been to take the car back to the dealer, park it on their forecourt and give them the keys. Tell them to call you when it's fixed, or issue a refund. In the meant time they either give you a loaner or you rent one and pass the bill to them.

    Force them to deal with it.

    Thank you - and yes I do I have an email advising me to take it to the garage & I have twice emailed them to check that they have told me to drive it to the garage even with the warning light on/ and the advice is not to drive the car (the garage is 4 miles away) .

    I wish I could take it back - the dealer is 300 miles away - hence why I cant - also I fear if I did go & drive down - something awful would happen to the car (due to the current issues) , so I would end up stranded somewhere with a even worst condition car

    I just want what i bought which was a 6 year car with a full service history/ mot til next may & no faults. Standard wear & tear etc all utterly fine - faults - not fine.

    I genuinely did not expect the car to be perfect 

    Again hindsight is wonderful and having never had to deal with anything like this before in terms of cars - I really though the dealer would be like " opps no worries, car has a warranty/ we'll get this sorted.

    Rather than - email us .

    I will name them once I have more info - again buying the car was easy/ sales folk were lovely on the phone (they moved a delivery time for me etc) - all which seemed very helpful & positive.

    No, what they're doing is expecting the OP to do all the running around for them when it's entirely their responsibility to sort this out.
  • It does feel a little like that - but as they are 300 miles away - I can understand them not (doesn't make it easier or better) 

     It would have been great if they had been like - we'll arrange for this to get picked up & checked locally as we do deliver nationwide & your car is covered under warranty.

    Its the radio silence & not know what steps to take/ or do.

    I also know the clock is ticking in terms of what I need to pursue - consumer act or the new distance regulation act - CRA.

    But I will know better once the garage come back to me.

    I just really wish the dealer would call & speak to me, and advise more clearly of what the steps in this instance at their side will be.

    (apologies for any spelling mistakes - I am dyslexic - just in case what I have written doesn't make any sense!)

    "Take" does not necessarily mean "Drive" - could mean to take it on a transporter.  Your e-mails saying you will drive it may not have been received - unless these have been specifically responded to.

    You can - this was a distance purchase plus the car is clearly faulty.  You can either exercise the short term right to reject (30 days) (CRA) or, probably simpler, the 14-day return for any or no reason under CCR.

    CRA requires you to cover off the faulty goods but the cost of collection should be covered by the suppling dealer.  You can give the opportunity to repair first, but don't have to (AIUI).

    CCR you don't need a reason, but may have to pay return transport costs.  This depends on the terms you were given.

    I rather feel that the supplying dealer is trying to run down the clock (especially on the 14-days).  If I were you, I would not mess about with getting the car to a local VW garage and would just reject under CCR.

    I would also not then buy a car from 300 miles away.
  • Mot was done in May 2021 - is valid until May 2022 - so I presume this was not there back in May (I bought the car via phone on the 30th of August 2021)
