 I was under the impression if a driver hits your car and is drunk or under the influence of drugs, their insurance would pay out to the third party but then hold the policy holder liable for the costscsgohan4 said:

 It will vary by insurer... Direct Line just exclude Personal Accident cover if under the influence, Aviva just exclude Recovery, Admiral and Axa will not cover own damage but will pay the third party losses,Retrogamer said:

 BUT wise to get the insurance in place, or get the car SORN'd and off road, so that there is no future issue in this regard. The fact they checked and got an "insured" response back means they are unlikely to check again. I wouldn't go inviting that information to the police.
 Obviously, any insurance now put in place is no use relating to the damage already incurred and from the description of events, the car is likely not repairable (?)

            The insurance on the car are claiming he hasn’t yet contacted them he was took away in the ambulance police were there at scene so what now does the insurer on the car still have liability toward my bwhicle surely they should be investigating0

 Yes, the insurance on the car should cover third party claims against the vehicle. I'm not expert, but I understand the insurance would still cover third party events even if the car is being driven by an unauthorised person - I am sure someone here will be able to give better information on that.frangroz said:What happens the car is insured but hees not insured to drive it has the insurance still got to pay my car is a total write off
 You should remember, though, that it remains your obligation to mitigate against any consequential costs. This is especially the case if you are using a claims company as they may inflate the claim (e.g. hire car costs) but be unable to recover the losses and then you would be liable. The best approach to assume is that you will end up paying for anything like that yourself, and then what you recover is a bonus.0

 If the driver is identified then they will be the RTA insurer if its a driver not covered by the policy.  There aren't any claims companies I am aware of that pass the costs back to the hirer if they have been honest and support the claim process... most agreements these days have slightly odd wording done for a specific reason that effectively says that the liability of the hirer is the award given by the court... this 1) means the hire car company can claim the monies from the TP because the Hirer does have a liability but 2) means the hirer isnt left with a bill if the court decides the £20,000 of hire should only have been £500.0
