Car insurance

My car was parked overnight at my girlfriends house got woken up by police to say someone had hit my car it was a mess he got it head on send it 400 yards down the road police checked my insurance everything was fine my car was on the motor insurance bureau as was his now I find out after phoning my insurance that it lapsed the other driver had accepted liability what to do now the car is a total write off

    If the other driver was to blame for the accident then the fact that your own car was uninsured has no bearing on
    your right to claim against him or his own insurance.

    From the civil issue of the damage to your car its an irrelevance. To the criminal matter of having an uninsured vehicle that hasn't been SORNed, that'll be up to the police/DVLA
  • Thank you what do you suggest is the best way forward I spoke to a company who deal with third party claims but will they ask for my insurance details to I’m at my wits end with it all

    Ruddy hell.  That is a quarter of a mile.    If it wasn't so frustrating for you, you would be impressed it pushed it that far.

    You have probably dodged a bullet there.  The fact they checked and got an "insured" response back means they are unlikely to check again.   I wouldn't go inviting that information to the police.

    As above, claim off the other insurers

    However there are some clauses that mention if under the influence they will not cover, I am not sure if they will cover third party damages, but definitely won't cover the driver under influence for their damages

    Yes you can. The Road Traffic Act prevents insurance companies from using drink or drugs as a reason to avoid a third party claim (it's covered by "the physical or mental condition of the person driving the vehicle).
