Holy Trinity Car Park Newquay
NTN
Good evening all,
The keeper of the vehicle received a PCN after arriving and leaving the Holy Trinity Car park in Newquay administered by ParkingEYE.
Time spent in the car park was just over 10 minutes, no parking was paid for as the machine wouldn't accept some coins and due to the poor signal it took well over 5 minutes to download their app and kept crashing when we tried to pay; as a result we left after what we thought was less than 10 minutes to find a car park that would take payment. There is an argument as no parking was paid for, no contract was entered. The signage was far too busy and complicated to read and it others were also having problems paying. I have read the Newbie thread and can confirm not a 'golden ticket'.
Yours thoughts on how to proceed appreciated.
Kind regards,
NTN

Hello and welcome.
What is the driver accused of doing wrong?
The keeper should send the blue text template appeal easily found in the first post of the NEWBIES thread.
Send it unchanged - no additions or alterations needed.2 -
I think there are a number of threads here about ParkingEye and the Holy Trinity Church. Search them out and see what you can glean from them. There's unlikely to be a silver bullet contained therein, but you can no doubt pick up some ideas about how they've been dealt with previously. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
