Submitted acknowledge of claim in time but have now received a default judgement.

I didn't copy the claimant on the defence no, is it still worth emailing the claimant on the proceedural error or can I only now deal directly with CCBC?

Concentrate on the CCBC , because it's likely to be their error1

If the claimant had been sent the defence on time, they would have likely joined the o/p in agreeing it was court error, which is why I raise the query.
Given the provision of cpr 15.6 which requires the defence to be served on every other party, my preference would always be to serve on the claimant and not just to file at court. Its also likely that C would not have applied for judgment as they'd have had the defence.4 -
I think in view of all the times this is happening, we should change our advice to copy in the Claimant’s solicitors when emailing a defence to the CCBC.
And to forward it again if no acknowledgement email comes back from the CCBC.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Redx said:Email a complaint to the CCBC and ask for a senior manager to investigate this , pointing out the timeline and a copy of the email in your sent folder too , you should have received an auto receipt email back from them on or around the 23rd , give them a copy of that auto receipt as well
There have been a couple of these in the last few months , read what happened in those tooI'm not sure what the best address to complain about the summary judgement actually is.There's ccbcaq@justice.gov.uk which is where the defence has been sent (and ignored, re-sent today.) should the complaint be referenced to the defence problem or do these issues need to be kept separate or go elsewhere?I've also seen ccbc@hmcts.gsi.gov.uk, ccbcdefendants@hmcts.gsi.gov.uk andccbc@justice.gov.uk suggested as a complaints address'.What's the most relevant thread/s here to look for further information, searching "summary judgement" doesn't turn up much about parking that I've been able to find, although maybe I'm not using the right criteria.

I don't know what the right search criteria is , nor the name of the member who had the same problem as you a couple of months ago , but I do know I have read it in the last 4 months , so my advice was do what they did , because the CCBC were going to ask a judge to consider striking out the CCJ and allowing the defence to be logged and the case proceed as normal from that point
You don't expect us to keep track of the hundreds of cases we see on here surely ?? I certainly don't , but I know that I read it , I would know it if you linked it and asked if it was the right one. I think the defence was emailed in the middle of June in the other case. They may have emailed the ccbcaq email address , which is where most emails go
You find it and I will confirm or deny , thank you
Ps , Umkomaas posted a link to the search box advice on here a couple of weeks ago , with a link to the mse help forum thread , have you read it ? It explains the new search procedures1 -
Forget those with hmcts in them. They're old.Norfolkrob said:I've also seen ccbc@hmcts.gsi.gov.uk, ccbcdefendants@hmcts.gsi.gov.uk andccbc@justice.gov.uk suggested as a complaints address'.
Perhaps your search is failing because you are using the wrong spelling of Judgment?Norfolkrob said:What's the most relevant thread/s here to look for further information, searching "summary judgement" doesn't turn up much about parking that I've been able to find, although maybe I'm not using the right criteria.
