Here is the page you need from Acas - https://www.acas.org.uk/working-safely-coronavirus/getting-the-coronavirus-vaccine-for-work

You may well have a case for discrimination under terms of the Equality Act 2010. But Acas can advise you about that anyway.

In fact, Acas is the place to ask this question because they are the ones who know the answer to your question definitively and they are the ones who can help if you DO decide to go to the Employment Tribunal with this. I once went to Employment Tribunal with a discrimination complaint against an employer during the application process. They settled, to my satisfaction, before the case went to court. You may well have a good case here. Whether or not my fellow forumites think it's a good idea to not be vaccinated. Acas! They are great. In my experience, anyway.
You have mentioned discrimination under the Equality Act before, where there is absolutely no evidence of any qualifying protected characteristics.
You really need to be more careful about posting misleading information.

I suppose you could argue about discrimination potentially on religious grounds if your religious beliefs prevent you getting vaccinated - but its very hard to prove that and of course is more an issue for those already employed not those who haven't started work (and vaccination was a condition of the job offer). This is being used by people in the US.

But its quite a stretch in this case.

Of course vaccination is not yet widely mandatory for many jobs in the UK - bar perhaps social care - but that may change.

    To quote the OP.

" I was given the start date in the follow up call where they then asked my clothing size and if i had had the jab. "
    Timeline

    Got offered the job

    Accepted the job

Got a phone call to advise start and told about jab

So accepted the job before being called and advised.

Maybe in the Job description they mentioned about the jab but you didn't read it,

I always wear FaceMasks in Shops/Transport/the concourse areas at football/when required at work,

All other time i don't wear a Mask I am fully Jabbed and proud to be :)

Summarisation (as there's only selective information being provided) . On hearing a mandatory jab was a requirement. The OP did nothing, except ring up the day before he expected to start. As the expectation was.........

I expected them to pay me for two weeks notice  because at every job I have had two weeks from the day you resign.

    You forgot one point:

The OP was called again to ask about clothing sizes and was asked again about vaccines at this point. Before he chased up his start date.

He did not confirm he had the vaccine which they had at this point told him twice was a condition of employment, they went elsewhere.

There is no legal claim here.

I am sure ACAS will give the OP the correct advice.
