MoneyClaim.co.uk

My daughter has received a county court claim form, the claimant being Vehicle Control Services. She wasn't parked in a resident's area even though they claim she was. She took photos at the time (approx 5 years ago) showing her car outside of the parking area ( Sign clearly visible saying no parking beyond this point) She wasn't.

A couple of questions if anyone can help.
On the MC website having selected the 14 day 'Defence' option,can you change your mind and opt for the AOS 28 day option? Issue date was 16th Aug 2021
Where and how can she send the evidential photos? It is from Northampton CC business centre.

    Q1 , no idea , the newbies FAQ sticky thread near the top of the forum explains how to do the AOS online correctly , it doesn't go into how to rectify mistakes

    Q2 , no evidence is submitted with the defence !! None at all , so no photos

    Why isn't your daughter dealing with this?

    In regard to the timescale to acquire the maximum amount of time for your daughter to submit a defence, forum regular @KeithP will be along soon to give some important detail.

    We are both dealing with it. She isn't registered on this website. Wasn't aware she couldn't ask her auld fella for assistance

    Please be specific. Which questions did you answer and how did you answer them?

    When you saw this screen, how did you proceed?...


    Your options were Start AOS  <<<--- should've chosen that
    Start Defence
    Start Part Admission or
    View Instructions

    Issue date was 16th Aug 2021
    With a Claim Issue Date of 16th August, you have until Monday 6th September to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS in a timely manner, you have until 4pm on Monday 20th September 2021 to file your Defence.
    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Of course where I have written 'you' or 'your' I mean the named Defendant.
  • There was an option to defend the case within 14 days rather than the AOS 28 day option. We did this and started to draft a defence which we haven't submitted yet. I then visited this site. Having seen the AOS advice, I then logged back on and noticed the AOS option still available and option to defend could be deleted

    That wasn't clear from your opening post. We have had situations in the past where someone other than the person who had received the charge took over 'responsibility' as a Knight in Shining Armour, dealt with it in their own name ..... and the whole show descended into a complete mess. 

    The auld fella can give as much assistance as he wants, provided both of you know that it's your little girl whose name and signature must appear on all the documents. 

    Onwards and upwards fella.

    That's a Scottish term.  Is this parking charge in any way connected to Scotland? A bit of a long shot on my part, but it's wise to eliminate any aspects not already fully exposed.

    Just went with the Start Defence option. When we log on that option is deletable with the AOS option still available. So can we now go with the correct option or by deleting the defence option will I mess things up?
