    As an aside from the original question - are you getting the retaining wall checked over as part of your survey/investigations?

    If it is retaining more than about a metre of soil then it starts becoming quite a liabilty - particularly in a rear garden where access for construction equipment is often restricted and repair/replacement is difficult (aka 'expensive').

    A good question thanks - we had a survey done which didn't flag up any concerns, but that'll be worth checking in more detail. Thankfully it's a fairly new property, so hopefully there's no issues (right now) but it sounds like one to keep an eye on for sure.

    Article 1(3) of the General Permitted Development Order (1995), states the following:

    "Unless the context otherwise requires, any reference in this Order to the height of a building or of plant or machinery shall be construed as a reference to its height when measured from ground level; and for the purposes of this paragraph “ground level” means the level of the surface of the ground immediately adjacent to the building or plant or machinery in question or, where the level of the surface of the ground on which it is situated or is to be situated is not uniform, the level of the highest part of the surface of the ground adjacent to it."
