Dealer didn’t disclose CAT D

I thought dealers had to disclose this, but it has only come to light when I came to sell the vehicle privately. 

I have legal cover under an insurance policy so will contact them on Monday for advice and to see what I can do, if anything, about the dealer. 

Does anyone know id there is a way of finding out what the damage was to cause it to be written off?  I guess with CAT D it could be something relatively minor, however vehicle was only three years old when written off.

    How long have you had the car?
    How old was the car when purchased?
    How old is the car now?
    Is the original Dealer whom you purchased the car from still trading?
    Did you undertake HPI check, or similar, prior to purchase?  If so, that is likely to be the most successful route for you to pursue anything as those checks (paid for) sometimes include cover against incorrect / incomplete information.

    They are supposed to tell you but it would be your word against theirs.

    A CAT D is usually sold at a small discount compared to a car of the same age. So the price of the car may help you if it boils down to it, was it sold cheap or at market value at the time of sale?

    As for finding out then no, but CAT D (now classed N) is cosmetic and could be something as simple as a dented wing. There is no safety related damage to a CAT D or N  

     
  • My current car was written off under a Cat D at 3 years old after the owner drove it through a flood and hydrolocked the engine. 
    The car got a brand new engine fitted privately and it hasn’t been a problem since, however.
