John Lewis damaged and urinated on my property.

    I know you did, it's macman who seems to think that I'm saying the reps understanding of this is correct, which I've never said.

    OP, I had an almost identical issue with an Argos fridge delivery recently although my flooring damage was nowhere near as bad as yours. I thought John Lewis would have had better customer service. Clearly not. I get the feeling those delivery guys didn’t want to bother bringing your fridge inside and this damage is due to them being belligerent and careless. 

    Ignore all the nonsense about ‘it’s the delivery company’s problem’. Stop the emailing. I wouldn’t bother trying a section 75 claim either. I found that just opened up more endless arguments. Send a letter before action and if they don’t respond (they will!) file the claim. Be sure to mention that you offered them a trolley and they refused. Mine was all sorted out within 3 days of them receiving my LBA.

    Thanks for the advice everyone. I think I now have no choice but to talk to my solicitor and send an LBA. 

    I am amazed at the John Lewis response. I couldn't even imagine this in my work with myself the main contractor on one of my jobs and then putting the blame out to one of my subcontractors. This would never happen as ultimately the responsibility would be on me. 

    The dented fridge tbh wasn't that big of deal for me and I probably could have lived with it. Coming home to my partner crying and seeing the damage to the floor got me rather angry though.

    30+ emails, phone calls and lots of empty promises from JL, I do wonder why it's taken a month for them to decide it's not up to them to correct the situation. 

    Horrible company!

    BTW you don't need a solicitor for a County Court claim in the small claims track ... and in fact you can't recover their costs either (other than perhaps £50).

    I wouldn't bother with the solicitor, unless you can get free advice. I'd just write the LBA stating that regardless of the exact relationship of the courier to JL, in this instance they are working as their agent and as such JL are fully liable for any damage costs that result in their negligence.

    Solicitor would cost more than repairing that floor.

    Thank you everyone for the advice. Was at a loss wondering what to do however I have sent an LBA & await a response.
    I'm more than happy for them to dispute and case go to court as I feel I'm completely in the right here. 
    Hopefully the more people who hear about this the better. I'm still amazed at John Lewis treating a customer like this but hopefully people will realise what a horrible company it's turned into!

    Will update when/if a resolution is found.

  • Hello I know it’s been a long time since your post about the issues with your floor. Did you get it resolved? The same thing happened to us last week, a fridge was delivered and they have scratched the brand new lime stone floor all across the kitchen to where they left the fridge, unpacked and uninstalled which we also paid for.
