PCN from PPS - advice needed

Hi everyone

I received a PCN today (12/8/21) issued by Private Parking Solutions (PPS) on 09/08/21.

The NTK is demanding a payment of £100 due to missed payment on the first PCN issued on 8/7/21. I did not receive the first PCN, nor a windscreen ticket on that day.

I actually appealed to PPS challenging the missing of the first PCN a few hours ago before I thought to look into the location. Now affter checking the PCN ticket I suspect that they have wrongly issued the ticket. The letter stated that I had parked on a no parking area at zone A+B Holloway st, Hounslow.

The few points to highlight,

1. main point, the car was parked on a pavement on Mattisse road, Hounslow TW3, NOT Holloway st. as stated on the PCN.

2 the private land parking sign was actually positioned on the wall facing a plot of land next to the pavement, not in front of the fence next to the pavement

3. There was no "no parking" signage visible, the double yellow line either

4. where I parked - Mattisse road, hounslow looks like a public road rather than a private land (which is beyond their jurisdiction?)

There has been no response so far. Any advise on how to proceed going forward, should they (in worst case scenario) reply and be uncompromising in stance, would be much appreciated (FYI have read around and aware of the 'one size fits all' first appeal template but unsure if that is still applicable..?)

Thank you in advance!

All the information in the newbies FAQ sticky thread near the top of the forum is applicable , including the blue text template if the V5C is in your name

Whatever your appeal says , or any discrepancies , won't alter the fact that they say you owe them money for an unpaid invoice for alleged breach of contract , so don't expect John Lewis standards and service , expect underhanded ex clamper obfuscation of the worst kind

Court is where these cases reach a conclusion

*correction- appealed a few hours before I looked into the location, not a few hours ago.

Received the PCN on 12/8 and drafted this post on the same night but only posting it today (16/8). Sorry for the confusion there!

Check with the council if that road is private or a part of the public highway and whose jurisdiction

    Redx,

Thanks and noted! Will get on that.

Rolling my eyes at these private companies and their opportunistic ways. Though I wonder if they will be persistent if I point out the location mistake? Am hoping this does not go all the way to court as I feel the blatantly wrong location is grounds in itself for the case to fall through (or am I wrong here? kindly advise if so!)

They will do as they please in this unregulated cowboy industry until the Mhclg introduce regulation next year

I suggest that you accept the futility of the situation and fill in the government consultation within the next 10 days !!

Have you complained to your MP?

    D_P_Dance,

thanks for your suggestion. Have you tried this in the past before? If yes, did your MP reply/lend any assistance?

With the help of my MP I received £100 compensation when I had to complain about an incomoetent judge who refused to reply to my letters.

    Hi Coupon-mad,

thanks for bringing these to my attention. Have done the gov consultation but not registered for DVLA action. Will look into it..

For this present PCN though, I’ve a reply from the council regarding jurisdiction. The road I parked on is an ‘adopted carriageway, therefore it falls under the council’s jurisdiction.’ What does this mean for me? Is it as simple as PPS having no authority to issue the PCN in the first place? Or is it more complex than that..? Appreciate pointers on next anticipatory move.

    yes, it is that simple.

Send your evidence to the DVLA
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
