Ive had a reply back from littlewoods and they said they rejected it.  Ive rang royal mail today to see if theres any tracking infomation and they said there would be if it was rejected.  Ive asked Littlewoods for traking infomation and proof of postage.

Depending on their answer im thinking of going to the small claims court as they cant prove they sent the parcel back to me.  If i lost my claim would i be hit with a large bill for fees on their side?
    This doesn't make sense.

It had their own returns label on so they would not have known that the incorrect stuff was inside until they opened it. They will get lots of post so don't just reject stuff.

They do have a duty of care with your items. Likewise when people get sent stuff in error they also have a duty of care to keep them safe until they can be collected.

Don't phone them. WRITE to them. Email will do. Tell them they have a duty of care for your items, they did NOT reject them, and they need to find them ASAP.
I did write to them stating they had a duty of care over my parcel and sent proof theyve recieved the parcel and they came back with "its a royal mail issue". Ive asked for their tracking infomation and proof of postage back to me, if they cant provide any ill take it further and pay the £50 court fee.

Letter Before Action, usually a threat to take them to small claims court.  What's the value of the parcel?
Its £508.  I was thinking of the small claims court but im going away for 5 months with work in October.
This is really awful, I'm so sorry.

It seems that you have done everything right so far but Littlewoods are being so unprofessional. Mainline can get it right, so why can't they?

I agree that you should proceed to court - and if you are going away in October just say that in the court papers you submit so they know you won't be available. Don't let it put you off and please don't write that money off, it's far too much to lose.

Also - do you have a Facebook or Twitter account? You could message Littlewoods through either or both. Businesses don't like being contacted via social media when they are in the wrong and it may make them sit up and take notice, especially if it's on Twitter. Even if you have to open a new account to do so.

It is 100% Littlewood's problem. Nothing to do with RM, as they delivered the parcel as instructed.

Make sure you send a final letter entitled "Letter Before Action" making it clear that the parcel was sent to them in error, they have a duty of care to keep it safe until it can be returned, you are happy to pay return postage to get your parcel back, and they have 14 days to return your parcel and invoice you for postage, or pay you £X for the value of the goods inside (enclose a copy of the receipt to show the value) otherwise you will have no choice but to take them to court for the value of the parcel.

The court fee can be claimed from them if you win.

We have lots of posts on here about people receiving duplicate orders in error and asking if they can keep them. And the answer is no, it is not theirs, it was sent in error, and they have a duty of care to look after the goods until the owner arranges to collect them. Same applies in this scenario.

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
