Website pricing error - rights

So found this on Mse mobile finder tool this morning

Ordered one, received email saying order had been successful (15:31) , then email to say it has been dispatched for delivery tomorrow (17:56).  About 5pm received phone call from them saying pricing was incorrect and that I would need to pay £125 upfront for this deal, said I wasn’t interested.

With phone due to be here tomorrow what rights do I have?

What phone is it? A recent iPhone or Samsung?

£32 per month over 2 years for an unlimited data plan AND a decent phone would likely fall into the realms of an obvious pricing error. In such circumstances the supplier is entitled to withdraw the contract offer (or revise it, as they have), which means you probably have no right to keep the phone and insist on the previous contract offer.

IF the phone arrives then reject the delivery.

For comparison, I'm paying £26 pm for EE unlimited everything (2yr contract).    But 3 do tend to have cheaper offers - personally I'd say this isn't an obvious pricing error if its a mid level phone.  New iphone 12 pro or Samsung S21 is possibly not.

The gap is the £125 upfront, not an obvious error on a 2 year deal that totals £768 in payments.

    I agree with this.

OP what does the website say about when a contract is formed/acceptance takes place?

Clearly under priced given the phone alone is  £800. Never mind the mobile plan.
So £125 upfront is a bargain.

The deal is ridiculously good, even with the £125 up front payment.  I'd grab it with both hands if you still want the mobile.
  • That's an absolutely fantastic deal, even with £125 payment!

You can't buy that phone anywhere for that price sim free so why is it not an obvious error?
