  • I've requested an SAR from Group Nexus and confirmed with DCB Legal that they will extend it to 30 days from today.  Am I right in saying I'm looking at the following as a roadmap:

    (a) Directions Questionnaire (N180) stage - an easy form.
    (b) Witness Statement & evidence and costs assessment stage.
    (c) A hearing at your local court (or in 2020, a Telephone Hearing if your local Court Judge is working from home).

    (y) submit AoS on-line
    (z) compile and submit defence.

    Not quite, assuming you have not yet received an N1 claim form.  See above.
  • I'll be honest... Since my original posts I've done nothing due to other personal/family matters.  I was days away from my deadline in the Letter Of Claim so I called DCB Legal (I know its stupid but I did) to ensure they received my email extending it for 30 days.  THey did and they have emailed back.  Basically I've been thinking of paying because the claim form/AoS/Compiling a defence witness statement, court hearing etc etc.. Its costing me far far more in time than the £170.  I still don't want to pay it but it seems tempting

    How long/complex is this process from here... when I give my reason for overstaying in the car park for 1h 25m over the allotted 2 hours (feeling unwell/tired/slept in car) will this be enough.  is it guaranteed I'm not going to end up with a CCJ?  what do I say when they ask what have I done with all the other letters they say they sent to me...?

    Your defence will take you 20 minutes to compile using the template to be found on the first page of the forum.  DQ takes 10 minutes, Witness Statement takes a bit longer but there are examples you can use on the forum.  This will be spread out over some months giving time for R&R in between each stage.
    I can guarantee you will not end up with a CCJ providing that you follow the guidance on the forum, if you move address, keep the PPC and the CCBC informed, and finally and most importantly, if you lose at the hearing PAY up within the deadline set by the judge.  BUT let's have no more talk of losing!
