Parking charge notice - Tower Road Newquay

Hi, I know there’s a big thread on the newbie section, but I was confused by exactly what I should do. I have received a parking charge notice for £100 (£60) if I pay within 14days but I would like to appeal the charge, as the only reason I can see that we got this charge is because the car entered the car park at 10.15 am and but by the time my daughter found a space,( it was a busy Sunday)  then she had to download the parking app which took ages as the signal wasn’t great, as she didn’t have enough change to pay at metre. She bought a ticket online for 3 hours which started at 10.33 as this is how long that whole process took and it just starts the time at the time you eventually get on. She left the car park at 1.30 but we have been given this penalty charge! What is the best way to appeal this. Many thanks for for help.

    In the big thread (sometimes called the NEWBIE sticky please read this first, there is a standard appeal written in Blue text.  did you find that?  If so, that is what is used.  It is sent by the KEEPER.  Do not be tempted to add additional wording.

    Did the claimant comply with POFA ? Yes or no ??

    What about plan A , before plan B ??

    What is unclear about the template where I say you CAN add relevant stuff but don’t imply who was driving?  Of course you can add a sentence about how busy it was, how it took 10 mins to find a space and park and then how long it took  to walk to the signs, queue up as it was busy, then read their app which took a good five minutes to download for the first time and attach a payment method and VRM to the system and pay.

    Of course people can add that.  They just need a template to stop people shooting their toes off and blabbing about who parked.

    It’s smart parking , the letter just says it’s for either not purchasing the appropriate parking time or by remaining at the car park for longer than permitted in accordance with the terms and conditions set out in signage. I don’t live in Newquay so cannot check on the signage and I’m not sure who owns the land to complain to them first? How do I tell if they have complied with POFA?

    The newbies FAQ sticky thread near the top of the forum in announcements tells you how to check for POFA compliance , or non compliance

    GSV can be used to check signage , plus the Newquay Facebook page , plus it's probably come up on here numerous times too

    There are many ways to check on landowner details , Umkomaas posts the list every week

    It's only Smart Parking who have never complied with POFA and if you read any other Smart threads, you'd know that and the extra line about the POFA, to add to the template appeal.  Search and read.

    The NEWBIES thread even tells you that Smart don't comply with the POFA. No need for Smart Parking threads, please, but we'd love an update when they cancel.
