Allay forged my signature and now AJJB are threatening legal action

  • I'm having the same issue with Allay Claims, and now AJJB, who are threatening me with legal action unless I pay the monies owed.
Like Mad4life, I clicked on a FB advert that asked for details to see if I was eligible for a pay-out, nothing more or less. I then received emails claiming they had initiated the claim, after I had received a letter containing a contract form, which I did not fill in or sign, or even send back to Allay Claims. I was contacted by the bank, who handled the case directly, confirming that Allay Claims had contacted them for information only.
When I demanded proof of any contract, Allay Claims sent me a pre-filled contract form with a digital signature at the bottom, with a copy of hand written signature that was not mine!
They also sent a file showing the IP address of the computer where this form was supposedly sent from - it didn't match any information on my system in the slightest. I never received any contract form via email from Allay Claims at all! In short, I never signed ANY contract with Allay Claims, and now they are using AJJB to collect on a debt that was never created.
Allay Claims are a fraudulent company, who lie cheat and steal monies that they are not owed. I instructed the bank to stop interacting with Allay claims, which they agreed to do. yet somehow they knew I had received a pay-out, and have been harassing me ever since for their commission, for a contract that was never signed.

It has been over 2 years since I last had any communications from Alley Claims, and am seriously considering legal advice to end this farce!

The chances of AJJB Law being unwise enough to issue proceedings are very small in my view. The amounts that Allay claim that 'customers' owe them are relatively small and given that legal costs are generally not awarded in the small claims court, it would cost AJJB/Allay more to bring an action than the claim is worth.

Allay did try taking a relatively high value case themselves last year. It didn't go particularly well. Despite Allay producing a 'digitally signed' agreement in their evidence bundle, the court held that the customer did not in fact sign it - effectively making a finding of fraud.

The court also ruled that even if the customer had signed, the agreement would have been invalidated as Allay had failed to comply with distance selling regulations which require them to provide the customer with the contract and prescribed cancellation form in a durable medium at the point of sale.

Never click on any of these ad`s on any social media platform.

Cowboy companies are everywhere, there have been lots of similar complaints to this one, people having clicked on an add, part filled in their details, then decided against it, yet have still been billed for services that were not wanted or agreed too.

Social media is awash with claims companies such as this, now PPI has more or less ended, they have turned there attention to packaged bank accounts, credit card charges, mis-sold mortgages, diesel car emission's claims, you name it.

Be very careful out there folks.

Why didn’t you receive payment from RBS? If it’s because they offset debt with your redress then you will still need to pay their bill unless they categorically did not ask you if you had outstanding debt etc as they shouldn’t have taken your case on as it’s highly unlikely on those scenarios that you will receive cash in hand but may still end up with a bill.
