Allay forged my signature and now AJJB are threatening legal action

Hi. You’ve probably heard my story many times but I’m jus seeing reassurance. I have a copy o the forged signature from Allay and after pointing out that it was forged I didn’t hear from them for over a year. Recently I got some more letters from them but ignored them. Now I have a letter from AJJB on behalf of ALLAY threatening ‘potential legal action’. Do I  ignore this r should I get evidence together and get ready for court? Thanks for reading!

    Neither.  Tell them of your previous correspondence and evidence of the forged signature.

    Are you sure it is a forged signature and not an electronic signature?     A lot of firms used electronic contracts which puts in an artificial signature which would look nothing like yours but it records the IP address, date and time and email address it was completed.  The contract is then emailed to the person for downloading.

    Do I  ignore this r should I get evidence together and get ready for court? 
    Do not bury your head in the sand.   

    If you did not employ Allay and did not enter into a contract with them then you must reply back saying say you did not employ them and believe the contract to be forged (noting the above about electronic signatures in case it is that).  

    If you did not employ them then how do they know you received a payout and the amount to bill you?    You could contact the bank/lender/firm that the claim is in respect of and ask them if Allay was involved in the process at all. (ask for it in writing as it could be evidence if this does go to court or you are asked to provide papers).

    I have seen the signature and have a copy of it. I did not sign a contract with ALLAY. They had neither my email nor my phone number. It’s not a digital signature and it’s hand dated by somebody who obviously grew up in Europe as the numbers were not how we would write them.

    They know I received a payout because they sent the forged documents to my bank to make the claim. I’m currently trying to get the paperwork from my bank and intend to make a complaint about them not checking against my signature on file.
  • How did Allay get your name and which bank you had a PPI product with? They don't just randomly guess people's names and submit complaints on the off chance, without the letter of authority, the bank wouldn't talk to them anyway...

    I suspect I clicked a link in Facebook and stopped short of asking them to claim for me. Its happened to a lot of people. They lost a court case last year for the same thing. From what I can gather they are winding up now and selling off their debtors. I just need to know where I stand with the debt collectors.

    I use European style numbering.  As do many in the financial industry.   Indeed, it was one of the first things I was taught to do when entering finance.

    The numbering and signature  was how I knew for sure it wasn't me that signed in a stupid moment.

    Allay Claims Ltd (the main company) assigned the consumer 'debts' to Allay (UK) Ltd. Allay Claims Ltd are late filing their last accounts and looks like they're going to fold.

    I think they're doing this to avoid enforcement action by FCA which I have reason to believe is immanent. Allay used CRS debt collectors for a while (although I don't believe the debts were sold to them) but now AJJB law are sending legal threats on behalf of Allay to everyone. If you get a formal letter before action you must complete and return the form, indicating that you dispute the debt and it also gives you the opportunity to request any documents you want related to their potential action.

    The chances of them actually issuing a claim are, in my view, slim. Of the only 2 cases I know of where they took anyone to court they lost spectacularly.

    Thanks for this considered response. I feel a little less worried now. I haven't had the formal letter yet but I 2ill respond as suggested.
