    Apologies, took some digging but found Notice of Allocation letter sent in January - it does refer to WS.

    I'll prepare witness statement, and will have to figure out how I can share with courts / claimant ahead of trial date.

    Which leaves me basically a few days to put it together, if that. Crap I've messed up. 

    Am I right in saying that Claimant also will need to have shared all evidence they intend to rely on in court with me also?

    They have the same deadline as you.
    You may be lucky and see their stuff a day or so before, but probably not.

    They have the same deadline as you.
    You may be lucky and see their stuff a day or so before, but probably not.
    Would that render their evidence inadmissible at the hearing? 

    I suppose what I'm asking is that if they will be able file their statement(s) potentially late, surely I shouldn't be penalised if I miss deadline to submit WS?

    Do be aware that the claimant is not entitled to statutory interest on the whole sum claimed from 2017 if, on their own case,  the last PCN was issued in 2019.

    They could have sought a composite rate at a lower percentage,  but they have not.  Nor have they done individual calculations for each PCN (check - they won't have done). The interest claim here is a significant addition.  A professionally represented claimant should do better. 

    Given the unreliability of the claim as presented,  I would suggest that the safest course should be for the court to disallow the claim for interest in its entirety. 😉
