    It's very unlikely the contract says anything about it, they're buying a plot of land shown on a plan, being built in accordance with the planning permission (which will have taken into account the spaces provided for off road parking, the dimensions of the garage etc).

    Our docs (from 1994) just stated integral garage and double drive.

    When we first moved in we did park in the garage - but as each new car was slightly bigger than the last one, this became harder and harder.

    We finally threw in the towel with our new VW T-Cross last year.  Not the biggest of cars, being on a Polo chassis, but just not enough room to open the door when in the garage!

    Mr S now has his workshop and our car, like 90%+ of cars on our estate,  sits on the drive.

    No amount of legislation will make a quart fit into a pint pot, so I can't see how any 'laws' stating that cars must be parked in garages could possibly be enforced.

    If that was what the law said then the choice would be to buy a smaller car, or (if the legislation allows) have no car at all.

    Usually the 'laws' that people come up against are to the effect that a garage can't be used for something other than parking, or that parts of the outside space cannot be used for parking (certain classes of vehicle).

    It will either be planning conditions, or covenants, that determine how the space can and cannot be used.  A planning condition won't require you to own a car and park it in the garage, but it could say that the garage is to be used for parking and incidental purposes only.  A planning condition could also be used to prohibit parking on the driveway, or other parts of the garden, or on-street - leaving the option of using the garage for parking, or not having a car (parked in the vicinity of the property).

    The latter type of condition would be rare though, and might only exist in the era when the then UK Government had a brainfart of thinking that restricting parking at residential property was a good idea.  Although it could still be happening in areas where the local council still hasn't figured out just how big a brainfart that idea was.

    Sorry I meant from the advert they saw. The op says it said 3 parking spaces. To me that would be the drive (2 cars) and the garage (1 car).

    As the op is adament the garage is not classed as a space, I'm wondering (in the advert) how it was described (less what they signed).
