Tesco mobile contract question

I have a Tesco Mobile handset on a 36 month contract. I have just spent an age on chat with them regarding ending my phone usage contract, which on my account is described as '1 Month rolling.'

I was told that I could only leave if I paid of my handset contract and pointed to section 5 of this.

Are they correct?

    How many months into the 36 months are you?
    If less than the full term, then you have to pay off the remaining months. At the end of the 36 months it becomes a 1 month rolling contact.

    "Requires a 36 month credit agreement at 0% APR and a rolling monthly usage contract, both with Tesco Mobile Limited."
    Does this apply here?

    I’m eighteen months into the contract. I’ve no quibble with Tesco that I am in contract for the handset. It’s just that as my account currently says I have a 1 month rolling contract for usage I can’t see why I can’t terminate that now. In my contract documentation it only refers to handset,

    Does this apply here? 
    I'd suspect so, O2 have the same requirement for Refresh plans - from the O2 site:

    "Customers on O2 Refresh contracts

    If you’re on O2 Refresh, you won’t be charged early termination charges for your airtime contract.

    Your final bill will include any out-of-bundle charges you have incurred before termination and, if you terminate your airtime contract before paying off your Device Plan in full, your final bill will also include the lump sum you still owe under your relevant Device Plan credit agreement(s)."

  • This bit from the Tesco Mobile Pay monthly service terms & conditions seems to be the bit that links the Pay Monthly rolling contract (the Minimum Contract Period is a month) and the handset credit deal: 
    • If you cancel your contract after your Minimum Contract Period, but before the end of your credit agreement, you won’t have to pay an ETC but you will have to pay off your remaining mobile handset credit agreement;

    Sorry to say they are probably right, as Gavin has confirmed.

    If you are desperate to leave, but cannot afford the payment, chance your arm in your local carphone warehouse - they might do something if you are taking out a new contract!
